I urgently call on President Mbeki, the Government and the ANC leadership to withdraw the Expropriation Bill because
It is unconstitutional. It will lead to arbitrary deprivation of property because compensation will be determined by executive diktat; market value will be downgraded as a factor in deciding compensation; and the role of the courts will be limited to an absolute minimum.
It will seriously damage the economy. It will undermine domestic and foreign investor confidence. It will empower the State to expropriate any property (not just land) for any purpose that the State may deem to be in the public interest. Security of ownership of private property is a fundamental requirement for all successful economies.
It will threaten South Africas food security. Most of the farmland that has thus far been expropriated has experienced substantial declines in production. Successful food production requires large-scale farming; large capital reserves; high levels of technology; and extensive experience and training.
It will place serious strains on interracial relations. Apart from its proclaimed objectives, the Bills primary intention, stripped to its essence, is to deprive South African citizens - against their will and on the basis of their race - of property in which they might have invested their lifes labour and resources; and with which they might have deep and long-standing emotional and family connections. It will inevitably be widely viewed by the targeted community
o as an assault on a fundamental constitutional right;
o as an attempt to limit the protection that citizens can expect from the courts; and
o as another blow to the national accord that South Africans negotiated between 1990 and 1996 - and upon which any hope of national unity depends.
It is unnecessary. More than 5\% of agricultural land comes onto the market each year. The Government owns vast tracts of land that can be used for redistribution. Organised agriculture has repeatedly expressed its willingness to work with government to promote fair, effective and sustainable land reform.

Dit is ongrondwetlik. Dit sal lei tot arbitrкre onteiening van eiendom omdat vergoeding deur die uitvoerende gesag bepaal sal word; markwaarde as 'n faktor by die besluit oor vergoeding sal afgegradeer word, en die rol van die howe sal tot die absolute minimum beperk word.
Dit sal enorme skade aan die ekonomie berokken. Dit sal binnelandse en buitelandse beleggersvertroue ondermyn. Dit sal die Staat bemagtig om enige eiendom (nie net grond nie) te onteien vir enige doel wat die Staat as in "openbare belang" beskou. Sekerheid van eienaarskap van privaat eiendom is 'n fundamentele vereiste vir alle suksesvolle ekonomieл.
Dit sal Suid-Afrika se voedselsekerheid bedreig. Die meeste van die plaasgrond wat tot dusver onteien is, toon wesenlike dalings in produksie. Suksesvolle voedselproduksie vereis grootskaalse boerdery, groot kapitaalreserwes, hoл vlakke van tegnologie, en omvangryke ondervinding en opleiding.
Dit sal ernstige stremming op verhoudinge tussen rasse plaas. Ongeag die verklaarde oogmerke daarvan is die primкre bedoeling van die Wetsontwerp, gestroop tot die kern, om Suid-Afrikaanse burgers teen hulle wil en op grond van hulle ras te ontneem van eiendom waarin hulle hulle lewensarbeid en hulpbronne gestort het en waarmee hulle diep en jare lange emosionele en familiebande het. Dit sal onvermydelik wyd deur die geteikende gemeenskap gesien word
o as 'n aanslag op 'n fundamentele grondwetlike reg;
o as 'n poging om die beskerming wat burgers van die howe kan verwag, te beperk; en
o as nog 'n terugslag vir die nasionale akkoord wat Suid-Afrikaners tussen 1990 en 1996 beding het en waarvan enige hoop op nasionale eenheid afhang.
Dit is onnodig. Meer as 5\% van landbougrond kom elke jaar op die mark. Die Staat besit groot stukke grond wat vir herverdeling gebruik kan word. Die georganiseerde landbou het al herhaaldelik sy bereidheid te kenne gegee om met die regering saam te werk om regverdige, doeltreffende en volhoubare grondhervorming te bevorder.
