Villa Castillo HOA Garbage Disposal Rule sign now

We, the undersigned and homeowners at Villa Castillo, oppose the new rule/regulation stating that trashcans must be stored out of sight when it is not a designated pickup day. This rule recently changed to hold the property owners responsible for keeping 2 trash cans inside our garages.

Keeping the trash cans inside our garages is not a reasonable request for the following reasons:
1. It is unsafe. This could become a hazard issue when bacteria grow inside the trash cans, particularly during the Summer months. It is also attracting undesired animals inside by keeping decomposing food in our houses.
2. It is unhygienic. After all, it is trash inside our houses. Our garages are too small and having the trash cans inside our garages is equivalent to having them inside our houses. Some families have small children and need to dispose diapers which make it unhygienic to have the trash inside. This situation gets worse during Summer time.
3. It is inconvenient. Many garages simply do not have the extra space. Convenience must be taken into consideration, specially living in a townhouse like we are which is already considered a small space. In addition, there are too many trash cans. We have not 1 but 2 trashcans per household. (One bin for the regular trash and another bin for the recycling trash).

We are truly concerned that changes to the original rules and regulations are being implemented with such a small vote count. If there are homeowners that are not comfortable with keeping the trashcans visible due to ornamental or decorative reasons, we suggest the committee develops a plan in order to address this concern. We believe an acceptable trash management plan shall be established and followed through as proposed in previous meetings. An example of this is to build an area for the trash cans to be conveniently situated outside our garages where it is easier for us to keep them out of site.

We believe the new trash can rule has a negative impact on the health and well-being of people who enjoy and live in this community. Looks should not come before safety, hygiene, and convenience.

We want to revoke the new rule to the original Garbage and Trash Disposal rule stating that garbage shall not be visible, but rather kept in a garbage bin. It does not state what to do with the garbage bin; this shall be to the discretion of the homeowner.

For reference, previous Garbage and Trash Disposal Rule:
No garbage, refuse, or rubbish shall be deposited or kept on any lot except in a suitable container (referring to a garbage bag). Such a container shall be placed in an underground receptacle or shall be shielded by a garbage bin so that the container (or garbage bag) is not visible from any point on the front lot line of said lot. Refer to Declaration of Restrictions and Protective Covenants page 7 point number 27 for more details.

We, therefore, stand in support of revoking the new Garbage and Trash Disposal Rule and reestablishing the previous, allowing the homeowners of Villa Castillo the flexibility to decide the location of their garbage bin.
