USDOJ Santana/San Diego Investigation sign now

To the Attorney General of The United States of America:

We the undersigned, hereby request a full and thorough investigation by the United States Department of Justice, ordered under your authority, into all aspects of the California criminal case of People v Williams. This is an imperative, as to deny one individual justice, is to deny it to all Americans.

We maintain that the defendant, Charles Andrew (Andy) Williams was the victim of habitual and ongoing abuse, harrassment and/or assault at Santana High School, a facility within the Grossmont-Union School District of California. This school was funded by a USDOJ/COPS grant, specifically for the purpose of a known serious problem within it, which you have previously referred to as "an onerous culture of bullying". We believe the defendant suffered extreme mental trauma as a result of these factors and this has not been brought before the court.

We further maintain that Andy Williams may have been denied his public education opportunities as should have been properly made available to him within the guidelines of district policy and especially the "Student Handbook" of Santana High School. We believe there is evidence to prove this and therefore, would be a clear violation of his civil rights.

We maintain there are serious mitigating circumstances that have yet to be investigated in full, as well as a need for complete examination of all legal procedures under a law enacted within the State of California under a voter intiative wherein the voting public may have had false, improper or undue influence by contributors supporting it including former Governor of California, Pete Wilson, the California Correctional Peace Officers Association (CCPOA), corporate entities with clear potential gain from such a law being enacted as well as the current Governor of California, Gray Davis, who's re-election funding has been significantly increased by contributions of CCPOA.

While this law was upheld by the California Supreme Court (Manduley v California), it was not challenged upon all components of the individual case of Andy Williams, but rather co-mingled with the Manduley case.

Further, this law may be challenged upon other individual case(s) already decided or pending within California courts before the Supreme Court of The United States of America.

Andy Williams pled guilty to charges read in court on June 20, 2002. We do not believe that he was fully apprised of his rights as an adjudacated adult and the full use of same or of the extensive medical, legal and scientific professional assitance available to him outside of the public system. This is substantiated by the denial of private counsel to see him the day before what was to be a "Readiness Hearing."

This petition seeks the full power of the Department, including such action(s) which may cause the court hearing the case of People v Williams and any and all judges presiding over it to either halt the proceedings or declare a mistrial.
