US Immigration Reform sign now

Immigration reform is needed however, the United States Congress has failed to identify the appropriate types of reform that should be endeavored. We the undersigned provid the following recommendations as a framework for real immigration reform:



Basis Tentants of The Hixon Immigration Reform Bill of 2007.



1. In order to be a US citizen by birth, one parent must have been a US citizen at the time of the birth.



Rationale: When forging a new country, citizenship by birth made sense. In a time when traveling to your home country could take months and cost a lifes savings, citizenship by birth made sense. Today, international travel is relatively inexpensive and it is possible to be almost anywhere on Earth within 24 hours, citizenship by birth alone does not make sense. Many countries require one or both parents to be citizens for children to be eligible for citizenship; a one-citizen parent requirement is rational. Citizen by descent.



Citizenship by birth alone encourages illegal immigration and sometimes puts the unborn child at risk when expecting mothers travel during late term pregnancy to give birth in the US.



2. A well-regulated guest worker program is in the best interest of the United States and provides opportunities for foreign nationals. The guest worker program shall have no special path to citizenship or legal permanent residency.



The guest worker program shall be administered as follows. Temporary work visas shall be issued by the US federal government, be valid for 2-years, and be renewable 180 days prior to expiration indefinitely provided that the guest worker remains in good legal standing, gainfully employed, and healthy. The work visa shall allow free travel across US borders to country of origin during its effective period. Work visas, which have not been renewed, shall be surrendered to immigration officials at a point of entry/exit on or before the date of expiration. Failure to surrender an expiring work visa will result in a deportation order and federal warrant. In addition to deportation, the first and second offenses will result in a 1-year suspension of guest workers eligibility to apply for a guest worker visa and a $500 fine. Subsequent offense will result in mandatory 6 month prison sentence, deportation, and permanent suspension of eligibility for a guest worker visa. No preference is given for obtaining a guest worker visa following a suspension.



Guest worker visas shall have the same security measures as a US Passport to prevent forgery and provide for entry security.



Guest workers shall not be eligible for federal aide. Guest workers shall however receive a federally funded entry medical exam, which shall include a general physical and immunizations.



No provisions shall be made for guest worker family members or dependants to obtain temporary residency.



Guest workers convicted of a misdemeanor or felony shall surrender their guest worker visa, shall be immediately deported, and are no longer eligible for guest worker visas.



Wages earned under a guest worker visa shall be reported under a guest worker visa tax id number and subject to federal and state tax law; SSI shall not be deducted and credit is not given for Social Security Benefits.

Guest worker visas shall allow for Agricultural, Construction, Hospitality jobs, and other job categories specifically determined by majority vote of Congress.



Transition period 2007-2009. A total not to exceed eight million guest worker visas shall be issued at immigration and consulate offices domestically and abroad. Application must be done in person. Applicants must be fingerprinted, pass a 30-day background check, and not have been convicted of a misdemeanor or felony. No special consideration is provided for applicants illegally in the US. Current US immigration enforcement remains in effect.



Beginning in 2010 guest worker visa shall only be issued abroad with no preference for country of origin. Guest worker renewals have first priority; remaining available visas are issued by lottery. Enhanced enforcement measures take effect:



Businesses found to be hiring workers not eligible for employment in the US will be subject to a fine of $25,000 punitive damages per ineligible employee; whistle-blower provision takes effect whereby after successful prosecution, the whistle-blower receives 20\% of punitive damages. The remaining 80\% is diverted to immigration enforcement agencies.



Businesses found to be hiring workers not eligible for employment in the US will be subject to IRS audit for tax evasion, labor law violations.



Businesses found to be hiring workers not eligible for employment in the US will be prohibited from receiving federal grants, or contracts for five years.

Businesses found to be hiring workers not eligible for employment in the US will be subject to public notification via print media, radio, and television.

Illegal immigrants shall be subject to immediate deportation and permanent loss of eligibility for guest worker visas.

Illegal immigrants shall be subject to having bank accounts and assets frozen, subject to tax audit and punitive damages of $10,000.

Public Schools enrolling students in the country illegally shall face loss of federal dollars.

Police Departments determined to not enforce provisions of the Immigration and Nationality Act or Hixon Immigration Reform Act shall be ineligible to receive Homeland Security and other federal funds.

Guest worker visas shall remain capped at 8-million except by recommendation of the attorney general and a majority approval by the Congress.



Rationale: Providing guest worker visas provide for low skilled labor when the domestic workforce cannot meet the existing demand and help ensure a thriving economy. Guest worker visas provide for free travel to and from the United States eliminated the dangers associated with coming to this country legally. Provisions for guest worker families cannot be accommodated due to the burden placed upon public services however; having a properly documented visa will allow guest workers to travel freely to visit families. Guest worker Health exams and immunizations ensure the health of the guest worker and help protect the US population from infectious diseases. The transition period will allow illegal immigrants already in the US to apply for a guest worker visa. If a guest worker visa cannot be obtained, there is sufficient time to sort out financial affairs and return to their country of origin before enhanced enforcement is enacted. [There is no grace period and continual enforcement will be in effect.] The transition period will also provide businesses a reasonable period to adjust their workforce to comply with existing law before enhanced enforcement is enacted. Whistle-blower statutes provide for public participation in enforcement actions against businesses. Increased penalties for illegal immigrants provide additional deterrence and is rationale based upon the additional legal opportunities for legal work visas. Public education enforcement helps to ensure that per student spending is maximized and improves the quality of education. Police department enforcement ensures that the federal immigration laws receive the appropriate local enforcement.





3. Legal Permanent Resident visas shall be capped at 300,000 per year.



Rationale: This limit represents approximately 0.1\% of the current population each year.
