Wearing Of Fake Medals & Liscense Plates A Felony In N.C.



This is a petition asking the North Carolina Legislature to sponsor and pass a Bill which would impose felony charges upon someone wearing medals & ribbons that are not indicated on a legal DD-214 Discharce Statement and also applies to the display of Vietnam Veteran,Disabled Veteran,Purple Heartand other such liscense plates without a properly inspected DD-214 discharge statement. This Bill would be simular to H.R.3352 introduced in July 2005 to the 109th Congress by John Salazar, D-Colo. The pure plan truth is that a Medal can be bought for $20 or less over the internet.Under the present provisions of U.S. Title 18, there are many Medal of Honor imposters that are able to avoid prosecution due to loopholes in Title 18, Section 704. That legislation makes it a crime to wear the Medal of Honor if a person hasn't been awarded it, but does not make it a crime to fraudulently claim to be a Medal of Honor Recipient.



The new law would close the loophole requiring the actual wearing of the Medal.



This would put at risk for criminal prosecution imposters who, for instance, put on their resumes that they are Medal of Honor recipients or others who might hang a Medal of Honor or bogus citation on their wall to give the impression that they are recipients. We would ask that a fine of $10,000 and up to 10 years imprisonment be considered for violations concerning the Madal of Honor. For the false wearing & possession of other medals ,I will use Mr. Salazars statement from H.R.3352; Other Medals- If a decoration or medal involved in an offense under subsection (a) or (b) is a Distinguished Service Cross awarded under Section 3742 of title 10, an Air Force Cross awarded under section 8742 of section 10, a Navy cross awarded under section 6242 of title 10, a silver star awarded under section 3746, 6244, or 8746 of title 10, or a Purple Heart awarded under section 1129 of title 10, or any replacement or duplicate medal as authorized by statute, in lieu of the punishment provided in that subsection, the offender shall be fined under this title, imprisoned not more than 1 year, or both.'. which we would ask to be increased to a $2000 fine & 2 years imprisonment. For the display of liscense plates such as the Vietnam Veteran Plate, if it is not postivitly confirmed on a DD-214 then ,and againn I quote from H.R.3352 and would redesign it to say;Whoever falsely represents himself or herself, verbally or in writing, to have been awarded any decoration or medal authorized by Congress for the armed forces of the United States, or any of the service medals or badges awarded to the members of such forces, or the ribbon, button, or rosette of any such badge, decoration or medal, amd displays such on a N.C. State Issued Liscense Plate shall be fined $500 under this title or imprisoned not more than six months, or both. These rampant acts bring dishonor to those servicemen & women from the state of North Carolina who so freely shead their blood in the name of freedom!
