دست از تبعیض ایرانیان بردارید


اداره مهاجرت هلند بررسی پرونده های مربوط به صدور ویزا و تمدید اقامت ایرانیان را به حالت تعلیق درآورده است. وزیر خارجه هلند علت تعلیق را مصوبه اخیر اتحادیه اروپا اعلام کرده است. در این مصوبه – فارغ از صحت یا عدم صحت آن – منع انتقال دانش فنی در زمینه اشاعه و با هدف تشدید تحریم ایران مورد تایید قرارگرفته است. با این وجود هیچ اشاره ای به اعمال محدودیت نسبت به اتباع عادی ایرانی نکرده است.

دولت هلند در سال 2008 (UN resolution 1737) نیز محدودیت های ناعادلانه ای را نسبت به اتباع ایرانی اعمال نمود. این تصمیم پس از اعتراض اساتید و دانشجویان سراسر جهان و پیگیری در محاکم قضایی هلند، به دلیل تعارض با اصل عدم تبعیض، همچنین قانون اساسی هلند و کنوانسیون اروپایی حقوق بشر در سال 2010 ملغی اعلام گردید؛ ولی با این حال دولت هلند علیه این حکم درخواست تجدید نظر داده است.

ما امضا کنندگان، این گونه برخوردهای نامتناسب را از مصادیق آشکار تبعیض دانسته که با قوانین بشر دوستانه هلند و منشور حقوق بشر منافات دارد. از دولت هلند می خواهیم درباره این سیاست تجدید نظر نموده و با اتخاذ تصمیمی مسئولانه از بروز آثار نامطلوب آن پیشگیری نماید.



Stop discrimination of Iranian people


Dutch Immigration and Naturalisation Services have put on-hold processing of Iranians’ applications related to Residence Permit (MVV), and the residence extension. Mr. Rosenthal, Dutch Minister of Foreign Affairs, has attributed this suspension to the recent EU regulation issued on 23rd March 2012. Although the said EU-regulation was legislated to fulfil tighter sanctions including the prohibition of transfer of certain technologies to the government of Iran, it gives no direction to punish ordinary Iranian nationals.

The Dutch government had previously exerted unjustified restrictions over Iranian nationals in 2008 (UN resolution 1737). This led to many complaints from students and academics worldwide. In 2010 the Dutch court of justice has ruled against these restrictions, due to violation of non-discrimination principle, Dutch Constitution and European convention of human rights. However, the Dutch government has appealed against this decision.

We, undersigned, believe that the new restrictions by the Dutch government are in contradiction with international human rights as well as the humanitarian laws of the Netherlands. We urge the Dutch government to revise such restrictions and take responsible measures to avoid discriminatory consequences for Iranian nationals.



Stop discriminatie van Iraniërs


De Immigratie en Naturalisatiedienst (IND) heeft aanvragen voor een verblijfsvergunning van Iraanse kenniswerkers in de wacht gezet. Dit is door minister van buitenlandse zaken, de heer Rosenthal in gang gezet om exact te bepalen hoe de recent verschenen EU-verordening 267/2012 op Iraniërs toegepast moet worden! Het veronderstelde doel van deze verordening is om de overdracht van proliferatiegevoelige informatie naar Iran te voorkomen. Hierin zijn echter geen eenduidige richtlijnen beschreven t.a.v. aanvragen of verlengen van verblijfsvergunningen van Iraanse arbeids- en kennismigranten en wetenschappelijke onderzoekers.

De Nederlandse regering heeft reeds in 2008 naar aanleiding van VN-resolutie 1737, verregaande restricties gevoerd t.a.v. toelating van Iraanse studenten tot bepaalde studies. Dit leidde tot veel protest van studenten en academici wereldwijd. Ook werd deze regelgeving is 2010 door de rechtbank in Den Haag als discriminerend en stigmatiserend geacht. Desondanks ging de regering in beroep tegen de uitspraak en bleef het studieverbod op bepaalde studierichtingen bestaan.

Wij, ondergetekenden, maken ons ernstige zorgen over de toekomstige besluiten van de Nederlandse regering en vinden deze houding discriminerend, disproportioneel en onacceptabel. Wij verzoeken de Nederlandse regering de besluitvormingen te herzien en het invoeren van restricties die de mensenrechten schenden, te vermijden.
