Silver Hill Solar Rights sign now

A proposal to turn the Silver Hill neighborhood into an Historic Overlay Zone and a Design Overlay Zone is close to being presented. Historic Overlay and Design Overlay Zones are the most restrictive zoning used by the city of Albuquerque. Among other restrictions, the new zoning would require property owners in the Silver Hill neighborhood to receive a Certificate of Appropriateness from the Landmarks and Urban Conservation Commission in order to do any exterior work on buildings or fences. The Design Overlay for the rest of the neighborhood would include fewer regulations.

The current draft of the Sector Development Plan Amendment calls for possible restrictions on future rooftop solar energy collection with the wording Panels and other equipment for solar energy collection may be mounted on roofs, but shall be sized, placed, oriented, and finished to minimize their effect on the buildings exterior appearance from the street.

As sun energy collection is an evolving alternative energy, we shouldnt be regulated against future designs and opportunities to create energy for ourselves and our neighbors. The visual aesthetic from the 1920s should not be used to restrict how we collect solar energy in the future. As Silver Hill was the first to address solar access in 1978, now we can be in the forefront of solar system integration without restrictions.

Likewise, protecting current and future use of water catchment systems is obviously essential in Albuquerque and should be protected from the start.

The undersigned ask that the wording above be removed and replaced with the following:

Solar energy systems and water catchment systems are not subject to decision by the Landmarks and Urban Conservation Commission in the Silver Hill Historic Overlay Zone.
