Require the Clerk of the Florida Circuit Courts to Amend All Felony Case Numbers Assigned to Misdemeanor Traffic Appeals sign now

Background (Preamble):

The Clerk of the Pinellas County Florida Circuit Court has engaged in inexplicable practice of assigning felony case numbers to misdemeanor traffic citations on appeal with apparent disregard of the consequences to the Appellee.

The Clerk of the Court maintains that the assignment of felony case numbers to misdemeanor traffic appeals was unavoidable, the result of the programming of the County and District court computers. Further the programming of the County Court computers did not allow for changes to those felony case numbers already assigned to the misdemeanor traffic appeals.

Despite the supposed limitations set by the countys computer software, this practice was allegedly abandoned by the Clerk of the Court in the year 2001. Though future case designations of misdemeanor traffic appeals were no longer to receive felony case designations, the Clerk of the Court continued to maintain that the courts computer system did not allow for the amendment of previous felony case designation assigned to misdemeanor traffic cases on appeal. This assertion proved to be incorrect.

The author of this petition contacted the Clerk of the Court in December 2003, after learning from a potential employer that he could not be offered employment due to a felony which appeared on a background check on January 18, 2008. The Clerk of the Court continued to maintain that an amendment of the felony case number assigned to the misdemeanor traffic appeal with the Circuit Court was not possible though the 2nd District Court of Appeal found it within their capabilities to amend their felony case number designation after receiving the case on further appeal. After four years of repeated complaints, the author of this petition petitioned the Chief Judge of the Circuit Court of Pinellas County Florida to amend the felony case designation. An Order was signed by the Chief Judge of the Pinellas County Circuit Court on January 18, 2008, to compel the Clerk of the Pinellas County Court to amend the felony designation to that of a misdemeanor, Larry Welenc V the State of Florida, case no. 08-00013APANO.


Petition:

We, the undersigned, ask that Clerk of the Pinellas County Court and all other Florida Courts engaging in the above practice, to cease the assigning of felony case numbers to misdemeanor traffic citation on appeal, and to amend immediately, all such felony cases designation assigned to misdemeanor traffic citation on appeal for all individuals concerned.

We also ask that the Clerk of the Pinellas County Court monetarily compensate all those who have suffered loss of employment or were denied housing or suffered any other loss as a result of the willful or unwillful negligence of the Clerk of the Court in either initiating and/or allowing this practice.
