We the undersigned are citizens of India most humbly bring certain facts before you with a request to please do not issue orders to transfer Justice Jagdish Bhalla to High Court of Chhattisgarh at Bilaspur.

1. There are reports that Justice Jagdish Bhalla has been transferred to High Court of Chhattisgarh at Bilaspur. Earlier on he was transferred as Chief Justice of Honble Kerala High Court. Taking note of the objections raised by few intellectuals of Kerala, you had sent the file back for reconsideration on 15th February 2007. Subsequently, in April 2007, the Supreme Court collegium issued orders transferring present Chief Justice of Chhattisgarh High Court to Kerala, while Justice Bhalla is waiting for the orders to join as the Acting Chief Justice at Chhattisgarh High Court.

2. We bring to your kind notice that the Committee on Judicial Accountability, (COJA) a credible non-government organization which includes such well-known legal personalities as Mr. Justice Rajendra Sachar, former Union Law Ministers Shanti Bhushan and Ram Jethmalani, and Indira Jaisingh, have raised serious charges of corruption against Mr. Justice Jagdish Bhalla of the Allahabad High Court, who has now been recommended for transfer to the Chhattishgarh High Court.

In a communication to the Chief Justice of India on July 11 last year, COJA alleged that Justice Bhalla had amassed several properties illegally in the name of his wife and other close relatives.

COJA has claimed that it is in possession of documents, which establish that on July 21, 2003, Justice Bhalla's wife, Renu Bhalla, bought from an alleged land mafia a 7,200 square meter plot at Noida, of which the market value is officially estimated at Rs. 7.2 crores, paying just Rs. 5 lakhs. Some of these reports have appeared in the media in the past.

COJA has stated that its request for a meeting to discuss the matter has been pending with the CJI for several months. Its plea for permission to file an FIR against Justice Bhalla has also not evoked a response.

3. If the Honble Chief Justice of India grants COJA permission to file an FIR or Parliament initiates impeachment proceedings, as has been suggested by Shanti Bhushan, Justice Bhalla will have the opportunity to clear his name. Even if such an opportunity is denied to him, it is possible for him to vindicate himself by instituting appropriate legal proceedings against those who have leveled charges against him.

4. We humbly bring to your kind notice that eminent lawyer and Union Minister Shri Kapil Sibal, while addressing press has accused Chief Minister of Uttar Pradesh Shri Mulayam Singh Yadav that he has misused discretionary powers in allotting plots of land in Noida to 99 people including judges, politicians, bureaucrats, media persons and some others close to him. The list released by Sibal included the name of Aarohi Bhalla, son of Justice Jagdish Bhalla.


With full respect to Justice Bhalla's right to be presumed innocent until the charges against him are proved through procedures established by law, we also believe it will be highly improper for him to take over as the Justice of the Chhattisgarh High Court on the strength of such presumption.

At a time when moral of people in public life has gone down, with many of our elected MPs alleged to be tainted, people of the country have great hope towards the judiciary, it is necessary to keep the faith alive. Under the circumstances, we humbly request you please do not send Justice Jagdish Bhalla to Honble High Court at Bilaspur, before he clears himself of the corruption charges by an independent inquiry.
