WE, THE PEOPLE, legal residents of the United States, to protect the safety of the public, request formal congressional oversight hearings and a full investigation by the Consumer Product Safety Commission (CPSC) regarding public safety, which is currently threatened by poorly monitored bicycle manufacturing processes that result in life-threatening product defects.



Some sixty percent of bicycles in the Unites States are manufactured in China and, Chinese firms have been involved in a number of product safety scandals recently, including tainted dog food, tires, toothpaste, Cub Scout badges, light fixtures, glitter candles, air purifiers, aluminum water bottles, key chains, baby cribs, and numerous toys. Evidence indicates that Chinese bicycle imports are subject to similar manufacturing and design quality issues, as substantiated by research and experiences outlined below.



Recently the CPSC initiated a recall for 25,000 children's bicycles manufactured by Iron Horse manufacturer and distributor World Wide Cycle Supply, after receiving several reports of injuries due to weld failures. Since that time, the Consumer Product Safety Commission has issued over 25 bicycle recalls, effecting over 200,000 defective bicycles.



In short, bicycle manufacturing is out of control and poses a serious risk to the lives of consumers that use bicycles.



Bicycle safety is a serious and significant issue with respect to children, as government reports show that nearly 400,000 children are injured in bicycle related accidents annually, with head injuries accounting for nearly 60\% of these.



The Bicycle Safety Advocacy Group has received and published numerous reports of bicycle manufacturing defects, including consumers that have experienced catastrophic frame weld failures on Iron Horse mountain bicycles. One consumer owned an Iron Horse bicycle for less than a year, when the swingarm weld became fractured causing the consumer to sustain an injury.



The Bicycle Safety Advocacy Group (BSAG) has consulted with experts in the field of metallurgy who have provided expert opinions that weld failures reported to the BSAG were the result of preventable manufacturing defects, known as "cold welds." A cold weld is a weld that has either not been heated properly or has been joined together with improper force. These welding failures are completely preventable when bicycle manufactures follow well-established welding standards such as ISO 17662:2005, Welding Calibration and Proper Verification and Validation of Welding Equipment.



There is significant probability that if manufacturing defects, such as the weld defects reported for Iron Horse bicycles, are not corrected, more people will experience failures and subsequent injuries. Weld failures in the frame and fork, as have continued to occurr, are serious failures that could cause riders to loose control, fall and suffer serious injuries such as facial abrasions, concussions, other head injuries, chipped or lost teeth, broken bones, and lacerations requiring sutures. Death is also possible.



Many of the experiences reported to the Bicycle Safety Advocacy Group illustrate bicycles that clearly fail to meet the requirements set forth in 16 CFR 1512, making them a banned hazardous substance under 16 CFR 1500.18(a)(12) of the Federal Hazardous Substances Act (FHSA) regulations and section 2(q)(1)(A) of the FHSA, 15 U.S.C. 1261(q)(1)(A).



Customer feedback about manufacturers, such as World Wide Cycle Supply, poor customer service (references provided at http://www.bikedefects.com) demonstrates the companys awareness of the issues surrounding their bicycles. The knowing introduction or delivery for introduction into interstate commerce of products considered banned hazardous substances are prohibited acts pursuant to section 4 (a) and (c) of the FHSA, 15 U.S.C. Sec 1263 (a) and (c).



We respectfully request Congressional Hearings on bicycle safety and what can be done to ensure that bicycle manufactures follow the laws and regulations enacted by Congress and government agencies.



We also request Congressional assistance in urging the Consumer Product Safety Commission to initiate a full investigation of overseas bicycle manufacturing and quality assurance processes, and suspected violations of 16 CFR 1512.
