It is unbelievable that how a people’s lawyer and human rights activist Shahnavas can become the target of a state that failed primarily and fundamentally to uphold the law and the constitution on the basis of which it has sought its legitimacy before the people. It is disturbing to note that a society and its institutions which vouches by the rule of the law has taken recourse to silence someone like Shahnavas who was only arguing the urgent need for all executive organs of the state, especially in Kerala, to uphold the law and the constitution. The vindictive attitude of the state knows no bounds as is tellingly evident from the surfeit of charges slapped on people’s lawyer Shahnavas. The sections run from 153A, 409, 465, 468, 471, 381, 477a, 201, 212, 218, r/w 120B IPC and Sec 4 of Police Force (Restriction of Right) Act 1956. That no case is made under any of these charges shows the politically motivated act of vendetta of the Kerala government.For bringing out the extra-constitutional act of the Hi-tech cell of the home department of Kerala government—when they resorted to hacking the mails of 268 odd people in Kerala of which the majority were from the Muslim community—is this what the state can do against someone who was upholding the law? To hack on the email of citizens without prior permission duly acknowledged by an authority is an infringement on the right to privacy of the individual. This is a violation of the constitutional right. Is this what the state can do to someone who was pointing out the dangerous policy of criminalising an entire generation of Muslim youth in the name of the so-called ‘war against terror’? Through this action can we say that the Kerala government has made it clear that no one should dare to defend the Muslim youth incarcerated under the charges of alleged SIMI activists ‘waging war against the state’? The manner in which the police and the intelligence agencies took away all the material of evidence from the office and house of people’s lawyer Shahnavas that was to be submitted a day later before the tribunal on SIMI is an open threat, a desperate attempt to silence all those who would want to expose the real state terror on the people.The very desperate act of the state in the arrest of people’s lawyer Shahnavas is an outright admission that the state has resorted to the criminal act of hacking mails of citizens so as to use them as pawns in their so-called war against terror.In the arrest and incarceration of people’s lawyer Shahnavas who was defending the defenceless, the state has declared war on the people. It is without doubt the vindictive state running amok to silence even a voice of reason who as a lawyer was pointing out the illegality, the criminality of a motivated policy of the state.
