Sir,
We would like to bring to your notice the facts regarding fabricated charges, misuse of the Gangster Act, arrest and custodial torture of a young activist, Afroz Alam, member of the CPI(ML)s state standing committee and National Executive member of the All India Kisan Mahasabha (AIKM) and seven other CPI(ML) activists.

Afroz Alam, 34, is an M. Com from Lucknow University, who opted to become a full-time organizer of the rural poor rather than pursue a career. He has been leading struggles in Pilibhit against land grab attempts by the land mafia. In particular, he had been resisting attempts by land mafia led by Congress leader B M Singh to turn the workers settlement of Rahul Nagar Mazdoor Basti into a farm house. On 2 July, the police invited Afroz Alam and 7 other activists to the police station on the pretext of talks. They were then arrested and serious false charges were filed against them including arson (Section 436), and SC/ST Act. They were badly beaten and subjected to brutal torture using rollers on their thighs. Eventually when the matter came to District Sessions Court and the Court questioned the polices conduct, Gangster Act was invoked against Afroz and the others, ensuring that the hearing for that case will now take place in the Gangster Court, Bareilly.

The Pilibhit police are intent on framing and targeting Afroz Alam because he filed a PIL and led a struggle against the custodial killing of a dalit youth, Rampal (who had been arrested over an inter-caste love affair, and badly beaten in custody when his family failed to pay a bribe) which resulted in jail for the guilty police personnel. The police is also acting in tandem against the local land mafia, against whom Afroz Alam has mobilized the rural poor on several occasions.

It is a deep travesty of justice that the Gangster Act, SC/ST Act and other serious charges are being falsely invoked to harass and incarcerate an idealistic young activist whose only crime is that he has helped rural poor defend their homes and colony against land mafia, and has struggled for justice in a case of custodial death of a dalit youth. All over Uttar Pradesh, those who are really gangsters and responsible for atrocities against dalits go scot free, while the Gangster Act and SC/ST Act are being used as tools of victimization of genuine activists.

We appeal to you to intervene to correct this gross injustice, and secure the release of Comrade Afroz and the other CPI(ML) activists, and the withdrawal of the fabricated cases against them.
