PETITION TO THE PRESIDENT OF THE REPUBLIC OF HAITI DEMANDING THE RE-OPENING OF THE HAITIAN DEVELOPMENT BANK (Port-Au-Prince, Mar. 17, 2010)

REGARDING THE URGENT NEEDS OF INTERNALLY DISPLACED PERSONS (IDP) FOR SUSTAINABLE, SOCIO-ECONOMIC PROGRAMS IN A RENEWED COMMITMENT TO A DEMOCRATIC LAWFUL HAITI:

WHEREAS permanent relief efforts for the victims (IDP) of the Jan. 12 earthquake require:
1. Grass roots, local, sustainable socio-economic development programs throughout the country;
2. Creation of an adequate banking system based on the rural cooperatives throughout the country;
3. An independent judicial system to fight corruption in the government and guarantee local investments under the democratic rule of law;

WHEREAS today, this process can be set in motion if the three following fundamental elements are allowed to operate:
1. The agricultural cooperatives network;
2. The Haitian Bank of Development BHD.
3. The Human Rights Advocacy and Watch dogging network;

WHEREAS More than 60 sq acres are available and ready at Galette Chambon, commune of Ganthier, for this project;

WHEREAS The Haitian Justice System has issued an order on April 13, 2006 to reopen the Haitian Development Bank (BHD);

WHEREAS the local authorities and the organizations in the commune of Ganthier are in agreement with this said project;

THEREFORE, WE THE UNDERSIGNED REQUEST:

1. Immediate support for existing local development projects by farmers cooperatives like the CIGC- Cooperative Investir dans Galette Chambon - in Ganthier, 20kms west of Port-au-Prince*;

2. Immediate execution of the Court Order to Re-open the BHD (Haitian Development Bank).**;

3. Guaranteeing the Rule of Law. Minimal judicial reforms of the Haitian judicial system already enacted must be implemented to assure its independence and proper supervision to wipe out corruption and interference by the other branches of government. The Haitian government must give access of all government archives and documents to all registered human rights and judicial reform organizations.

* In 2000, the CIGC joint-ventured with the BHD launching the BEL AZUEI project with professional Zoning, Engineering and Urbanism studies that are well advanced today.
This makes Galette Chambon operational immediately to host and care for 15, 000 refugees.

**After two years spent building an exemplary working relationship with the cooperatives, the BHD fell, in July 2001, into the hands of a new management under the supervision of the BRH/Central Bank of Haiti that allowed the depletion of its Reserve Funds. Shut down illegally by the BRH in 2002, the majority of the BHD shareholders fought for four years to bring the case to court. On May 4th, 2006, the First Circuit Court of Port-au-Prince issued its order (addendum A page 24) to the Central Bank to obey the legal procedures of Article 54 of the Banking Code, by appointing a Receiver to re-open the BHD for day-to-day operation, clarify its legal and financial situation and decide on its future within 180 days. To this day, the BRH/Central Bank of Haiti has refused to execute this ordinance. Haitian President Prйval needs to execute this court order and create confidence in the rule of law that will attract investments to build the country.
