Gary Eccher, D-36746, a California Prison Inmate, is well past the point he should have been paroled.

The facts of Mr. Ecchers offense, a second degree murder, as found by the Orange County Superior, were set forth as follows:

In 1986, petitioner [Mr. Eccher] killed his girlfriend after he had been free-basing cocaine for about six hours. They were both drug dealers, and the murder apparently followed an argument about him using up their saleable cocaine. The victim was beaten and strangled. Court Order, In re Eccher, dated November 3, 2004, Orange County Superior Court, Case M-10068, page 2.

Mr. Eccher is very remorseful about his offense and has devoted the last 20 years of his life to positive change. He feels that is the only way to honor the life and memory of his girlfriend. His commitment to this effort has been incredible. He has spent two decades in substance abuse and self-help therapy in order to change the pattern of behavior that led to this tragedy. Doctors claim his substance abuse problems are in full remission.

Mr. Eccher has been a model prisoner. He had no prior felony convictions. He has no history of violence during his 20 years of incarceration. While not making excuses for his conduct his crime was clearly situational and the product of his drug abuse. His psychological reports indicate Mr. Eccher poses no more risk to commit future violence than does the average citizen. Yet he remains in prison even though a prisoner must pose an unreasonable risk" to public safety in order to be denied parole.

Mr. Eccher has previously won a Petition Writ Of Habeas Corpus where a court found denial of his parole by the board was illegal. That decision was later overturned by a higher court. Yet Mr. Eccher is clearly suitable for release. His current incarceration continues to be without legal cause as there is no evidence he poses a threat to the community if released.

Gary Eccher deserves to be free. His friends and family urge all of you to sign this petition and let the parole board know that it is time for Mr. Eccher to be rewarded for his two decades of hard work and good behavior and to grant him the parole he has earned over the last 20 years.
