KOALICIJA ZA PRAVO NA IVOT U ZAJEDNICI:PLATFORMA 19 / COALITION ON THE RIGHT TO COMMUNITY LIVING:PLATFORM 19


U nastojanju da se prava osoba s invaliditetom u RH zatite u skladu s najviim demokratskim standardima i naиelima koje je naa zemlja usvojila, te uvaavajuжi sljedeжe иinjenice:

- da je socijalna pravda jedna od temeljnih vrednota ustavnog poretka u RH, da se Ustavom jamиi ravnopravnost svih graрana/ki, kao i njihova jednakost pred zakonom;
- da je Ustavom zajamиena sloboda kretanja, kao i sloboda odabira mjesta i naиina ivota za sve hrvatske graрane/ke;
- da je RH bila jedna od prvih drava u svijetu koja je usvojila i ratificirala Konvenciju o pravima osoba s invaliditetom (2007.);
- da je RH u procesu pristupanja EU potpisala Zajedniиki memorandum o socijalnom ukljuиivanju izmeрu RH i EU (2007.);
- da su osobe s invaliditetom podlone socijalnom iskljuиivanju daleko иeжe od ostalih graрana/ki, te da su meрu osobama s invaliditetom osobe s intelektualnim tekoжama i psihiиkim smetnjama najиeжe podlone i institucionalizaciji to predstavlja njihovo fiziиko uklanjanje iz zajednice;

mi, иlanice ove Koalicije, zahtijevamo da se pristupi punoj implementaciji Konvencije o pravima osoba s invaliditetom i da se omoguжi ravnopravno ukljuиivanje osoba s invaliditetom u drutvo.

Marginalizacija i iskljuиivanje posebno dolazi do izraaja u brojnim institucijama za stacionarni smjetaj i nedostatku slubi podrke koje bi osobama s invaliditetom omoguжile ravnopravan ivot u zajednici. Ogromna veжina osoba s invaliditetom nema adekvatnu materijalnu i drugu podrku za neovisan ivot u zajednici, a skoro 8000 ljudi ivi u institucijama, segregirani od drutva i zajednice.

Obraжamo se svima koji donose politiиke odluke o ivotu osoba s invaliditetom sa zahtjevom da se investiranjem u razvoj podrke u zajednici zaustavi praksa institucionalizacije. Ljudska prava svih osoba s invaliditetom moraju se potovati, kao to se mora osigurati njihov status ravnopravnih graрana.

Stoga, ova Koalicija, posebno zahtijeva punu provedbu Иlanka 19. Neovisno ivljenje i ukljuиenost u zajednicu Konvencije o pravima osoba s invaliditetom, kako glasi:
Zakonom osigurati praktiиnu i djelotvornu moguжnost da osobe s invaliditetom:
1. odaberu svoje mjesto boravka, gdje i s kim жe ivjeti, na ravnopravnoj osnovi s drugima, te da nisu obvezne ivjeti bilo kojim nametnutim naиinom ivota,
2. dobiju pristup irokom rasponu usluga koje жe im omoguжiti ivot i ukljuиenost u zajednicu te sprijeиiti njihovu izolaciju ili segregaciju iz zajednice
3. dobiju pristup i moguжnost zadovoljavanja vlastitih potreba kroz usluge, objekte i prostore namijenjene opжoj populaciji.

Ispunjavanje ovih zahtjeva, odnosno puna provedba иlanka 19. Konvencije o pravima osoba s invaliditetom, jedini je naиin za postizanje stvarne ravnopravnosti osoba s invaliditetom u drutvu.

The Coalition strives to ensure protection of the rights of people with disabilities in Croatia in accordance with democratic standards and with the principles adopted by our country, states:

- that social justice is a fundamental principle of the Croatian constitutional system and that equal rights as well as the equality before the law are guaranteed by the Constitution to every Croatian citizen;
- that freedom of movement and freedom to choose a place to live and a way of life is guaranteed by the Constitution;
- that Croatia was one of the first countries in the world to sign and ratify the Convention on the Rights of Persons with Disabilities and its Optional Protocol (2007.);
- that Croatia signed a Joint Memorandum on Social Inclusion of the Republic of Croatia in the process of accession to the EU (2007) that specifically sets out deinstitutionalization as a goal;
- that people with disabilities face social exclusion more often then other citizens, and among people with disabilities those with intellectual and/or psycho-social disabilities are most often institutionalized and removed from the community;

Platform 19 urges the full implementation of the Convention on the Rights of Persons with Disabilities to enable the equal inclusion of people with disabilities in society.

People with disabilities are marginalized and socially excluded in residential institutions, and this exclusion is worsened by the lack of community-based support services that would allow them to live in the community on an equal basis with others.

The vast majority of people with disabilities in Croatia have no appropriate financial or other support to live in the community, and almost 8,000 people live in institutions, segregated from society.

Platform 19 urges all political decision makers who impact the lives of people with disabilities to put an end to institutionalization by investing in the development of community-based alternatives. The human rights of all people with disabilities must be respected, and their equal status as citizens ensured.

Platform 19 emphasizes the need to fully implement Article 19 of the Convention on the Rights of Persons with Disabilities Living independently and being included in the community.

People with disabilities must have practical opportunities to:

1. choose their place of residence and where and with whom they will live on an equal basis with others, and not to be obliged to live in a particular living arrangement;
2. gain access to a wide range of services that will enable them a life and involvement in the community and prevent their isolation or segregation from the community;
3. gain access and ability to meet their own needs through services and facilities available to the general population.

Full implementation of Article 19 of the Convention on the Rights of Persons with Disabilities is the only way to achieve real equality of people with disabilities in society.
