IMPEACHMENT RESOLUTION
as amended


Whereas, George W. Bush was declared President of the United States earlier this year at a time when at least 60,000 votes were not counted in Florida due to the 5-4 Supreme Court decision.

Whereas, Article 1, Section 3 of the Constitution of the United States provides:

... The Senate shall have the sole Power to try all Impeachments. When sitting for that Purpose, they shall be on Oath or Affirmation. When the President of the United States is tried, the Chief Justice shall preside: And no Person shall be convicted without the Concurrence of two thirds of the Members present.

Judgment in Cases of Impeachment shall not extend further than to removal from Office, and disqualification to hold and enjoy any Office of honor, Trust or Profit under the United States: but the Party convicted shall nevertheless be liable and subject to Indictment, Trial, Judgment and Punishment, according to Law.

Whereas, Article II, Section 4 of the Constitution of the United States provides:

The President, Vice President and all civil Officers of the United States, shall be removed from Office on Impeachment for, and Conviction of, Treason, Bribery, or other high Crimes and Misdemeanors.

Whereas, Article III, Section 1 of the Constitution of the United States provides:

The judicial Power of the United States, shall be vested in one supreme Court, and in such inferior Courts as the Congress may from time to time ordain and establish. The Judges, both of the supreme and inferior Courts, shall hold their Offices during good Behaviour, and shall, at stated Times, receive for their Services, a Compensation, which shall not be diminished during their Continuance in Office.

Whereas, the American Bar Association Code of Judicial Conduct provides:

Canon 1: A Judge shall uphold the integrity and independence of the judiciary.

Canon 2: A Judge shall avoid impropriety and the appearance of impropriety in all of the judge's activities.

Whereas, 673 law professors from 137 law schools in the United States declare that the five justices who voted to stop the recount of votes in Florida last December intentionally acted as political proponents for candidate Bush, not as ethical judges.

Whereas, by doing so, Supreme Court Justices Rehnquist, O'Connor, Thomas, Scalia and Kennedy tarnished the integrity of the U.S. Supreme Court.

Be it resolved, if the U.S. House of Representatives determines that there is good cause for impeachment of any or all of the named Justices and if the U.S. Senate by a vote of at least two thirds of the Members present convicts one or more of the above named Justices, then the Constitution demands that the judgment is removal from office and disqualification to hold and enjoy any office of honor, trust or profit under the United States, but the party or parties convicted are still accountable for any crimes they may have committed.

Be it resolved, that the legislative branch of our government shall forthwith seek diligently the true facts and move with all deliberate speed to investigate this opportunity to remove the stain on Old Glory.
