Nota Penjelasan : Petisyen yang dipamirkan di sini telah disediakan tanpa menyertai bahasa halus yang sewajarnya untuk penyampaian rayuan rakyat kepada Duli Yang Maha Mulia Sultan Sharafuddin Idris Shah Alhaj Ibni Almarhum Sultan Salahuddin Abdul Aziz Shah Alhaj, Sultan Negeri Selangor Darul Ehsan. Ini akan dilakukan oleh pakar tertentu untuk salinan petisyen yang akan disampaikan kepada Tuanku Sultan kelak.

Memandangkan negeri Selangor sering dilawati oleh warganegara Malaysia daripada negeri-negeri lain, maka petisyen ini adalah terbuka untuk disokong oleh semua warganegara Malaysia dan bukan terhad hanya kepada penduduk negeri Selangor.

Patik, sekalian rakyat Malaysia yang secara lazim menetap di negeri Selangor berserta rakyat yang sering berkunjung ke negeri Selangor bagi pelaksanaan segala urusan yang sah, dengan ini memohon perkenan bagi mengemukakan petisyen ke hadapan Duli Yang Maha Mulia Sultan Sharafuddin Idris Shah Alhaj Ibni Almarhum Sultan Salahuddin Abdul Aziz Shah Alhaj, Sultan negeri Selangor Darul Ehsan, berkenaan perkara berikut yang dirasakan amat perlu diberi perhatian:

MANAKALA:

1. Tanggal 8 Mac 2008 pada Pilihanraya Umum ke-12, majoriti pengundi di pelbagai kawasan pilihanraya di negeri Selangor telah memutuskan untuk mengundi demi membuka ruang bagi pembaharuan dalam pentadbiran politik di negeri Selangor.

2. Selaras dengan kehendak rakyat negeri Selangor, Duli Yang Mulia Sultan negeri Selangor telah melantik dan memberi mandat kepada Menteri Besar serta Pegawai Eksekutif Majlis Undangan Negeri yang terdiri daripada ahli Parti Keadilan Rakyat, Parti Tindakan Demokratik, dan Parti Islam SeMalaysia, yang kini secara kolektif digelar Pakatan Rakyat, bagi menubuhkan kerajaan negeri Selangor

3. Pada bulan Mei tahun ini, Dewan Undangan Negeri Selangor telah meluluskan usul untuk menuntut agar Akta Keselamatan Dalam Negeri, 1960 (selepas ini dirujuk sebagai ISA) dimansuhkan serta pembebasan serta merta semua tahanan ISA yang ditahan di Kamunting, Perak (selepas ini dirujuk sebagai Polisi No to ISA kerajaan Selangor).

4. Seiring dengan Polisi No to ISA kerajaan Selangor, Menteri Besar Tan Sri Khalid Ibrahim telah:-

i) memberi jaminan bahawa negeri Selangor adalah komited dalam usaha menghulurkan bantuan kewangan serta kebajikan bagi keluarga mereka yang ditahan di bawah ISA; dan

ii) pada 29 November 2008, menyatakan sokongan serta melancarkan kempen berbasikal, Rakyat Pengayuh Perubahan, yang merupakan sebuah inisiatif Jaringan Rakyat Tertindas (JERIT) di mana sejumlah hampir 150 peserta telah menganggotai delegasi berbasikal merentasi tanah air dalam usaha menyampaikan mesej kesedaran tentang isu-isu semasa, termasuk kepentingan pemansuhan ISA.

5. Sejumlah besar, jika bukan majoriti, rakyat yang menetap di negeri Selangor beserta rakyat yang sering berkunjung ke negeri Selangor, menyokong penuh Polisi No to ISA kerajaan Selangor dan sehingga kini, pada 12 Oktober 2008, 19 Oktober 2008, 26 Oktober 2008, dan 2 November 2008 telah berkumpul bagi menyalakan lilin sebagai tanda solidariti di Dataran Petaling Jaya, Off Jalan Timur (selepas ini dirujuk sebagai Himpunan Solidariti Anti ISA PJ). Setiap perhimpunan ini menyaksikan keterlibatan yang memberangsangkan, di mana tuntutan secara aman, pembebasan semua tahanan ISA serta pemansuhan akta tersebut di suarakan. Kehadiran pegawai polis berpakaian awam telah dikenalpasti dalam kesemua himpunan aman tersebut, namun, sebarang perintah bersurai tidak pernah dikeluarkan. Selain itu, tidak ada sebarang arahan dikeluarkan oleh pihak polis berkenaan permohonan permit polis sebagai syarat mengadakan perhimpunan tersebut.

DAN MANAKALA DIAKUI BAHAWA:

6. Malaysia merupakan sebuah persekutuan di mana pembahagian kuasa eksekutif antara kerajaan persekutuan dan kerajaan 13 buah negeri yang membentuk persekutuan tersebut termaktub bersama batasan dan sempadan yang jelas dalam perlembagaan.

7. Seperti yang digariskan dalam Perkara 80 (1) dan Jadual Kesembilan, Perkara 1, Senarai III, fasal keselamatan dalam negeri termasuk pasukan polis adalah di bawah bidang kuasa kerajaan pusat

8. Berlandaskan Perkara 140 Perlembagaan Persekutuan, Suruhanjaya Pasukan Polis yang diwujudkan adalah bertanggungjawab bagi, antara lain, perlantikan, pengesahan, kenaikan pangkat, pertukaran dan penjalanan kawalan tatatertib ke atas anggota polis di mana setiap anggota polis menurut Seksyen 13 dan Jadual Kedua Akta Polis, 1967, tatkala menyertai pasukan polis atau sebelum memikul tanggungjawab secara rasmi, diwajibkan mengangkat sumpah untuk mematuhi, menegakkan serta mempertahankan undang-undang Malaysia disamping melaksanakan tanggungjawab serta menggunakan kuasa yang diamanahkan secara jujur dan tekun.

DAN MANAKALA, KINI, DENGAN PENUH KESAL, DINYATAKAN BAHAWA:

9. Pihak berkuasa polis di negeri Selangor yang dipimpin oleh Ketua Polis Selangor Dato Khalid Abu Bakar telah, bersandarkan pengendalian serta tindakan pihak tersebut dewasa ini, menunjukkan dengan jelas bahawa pihak berkuasa polis telah mengambil pendirian yang bertentangan dengan setiap langkah serta sebarang usaha yang menjurus ke arah merealisasikan pemansuhan ISA dan sehingga kini, pihak polis di bawah pimpinan Ketua Polis Selangor, mengatur langkah serta mengambil tindakan yang dicatur bagi melemahkan pendirian dan Polisi No to ISA kerajaan Selangor di samping menggoyahkan sokongan rakyat terhadap polisi tersebut.

i) Pada 9 November 2008, dengan kerjasama sebuah inisiatif bagi memperingati ulang tahun pertama Himpunan BERSIH yang telah berlangsung pada pada 10 November 2007, satu Himpunan Solidariti Anti ISA - PJ telah dijadualkan untuk mengambil tempat seperti minggu-minggu sebelumnya. Namun, pihak polis yang diketuai Ketua Polis Selangor telah memberi perintah bersurai, atas alasan permohonan permit polis tidak dilakukan. Rakyat yang hadir berundur ke Amcorp Mall di mana setelah lagu kebangsaan dinyanyikan, perhimpunan tersebut bersurai. Sebilangan dari yang hadir kemudiannya secara tidak dirancang dan spontan, telah berkumpul di taman di hadapan ibu pejabat MBPJ, Off Jalan Yong Shook Lin, di mana himpunan ini diibaratkan Himpunan kedua pada 9 November 2008. Setelah ucapan ringkas disampaikan dan ketika Negaraku dinyanyikan, anggota polis, atas arahan Ketua Polis Selangor menyerbu ke arah orang awam tanpa sebarang arahan bersurai serta tanpa memberikan sebarang amaran dan mencederakan sebilangan yang hadir disamping menahan sejumlah 23 individu.

ii) Ekoran dari kejadian itu, CPO Selangor telah dilaporkan dalam media, membuat kenyataan:-

a) bahawa perhimpunan pada 12 Oktober 2008, 19 Oktober 2008, 26 Oktober 2008, dan 2 November 2008 berlangsung tanpa menghiraukan arahan polis bagi memohon permit

b) bahawa pada setiap himpunan yang berlangsung pada 12 Oktober 2008, 19 Oktober 2008, 26 Oktober 2008, dan 2 November 2008, mereka yang hadir bersurai setelah perintah bersurai diberikan.

c) bahawa mereka yang berkumpul di Amcorp Mall pada 9 November 2008 telah menyanyikan lagu kebangsaan sebanyak tiga atau empat kali; bahawa setiap kali pihak polis memberi arahan bersurai, mereka yang berhimpun akan kembali berkumpul dan Negaraku dinyanyikan sebagai usaha menghentikan kemaraan pihak polis.

d) menafikan bahawa pihak polis bertindak menyerbu ke arah anggota awam dalam Himpunan kedua ketika lagu kebangsaan sedang dinyanyikan; dan

e) bahawa mereka yang berhimpun dalam Himpunan kedua telah diberi amaran serta arahan bersurai sebelum serbuan dilakukan dan beberapa individu ditahan.

10. Dakwaan Ketua Polis Selangor, seperti yang dinyatakan di 9 (ii) di atas adalah jelas tidak benar dan bercanggah degan bukti, yakni rakaman video serta foto di samping keterangan saksi yang hadir di Amcorp Mall dan Himpunan kedua

11. Sejak penangkapan 5 pemimpin komuniti Hindu yang dikini digelar Hindraf 5, masyarakat Hindu di Hulu Selangor telah berkumpul bagi menunaikan kewajipan bersembahyang serta berdoa untuk permbebasan Hindraf 5 bersempena upacara keagamaan Pournami Pooja yang berlangsung setiap bulan. Pada 10 November 2008, pihak polis telah memberi amaran supaya upacara Pournami Pooja bagi bulan November yang jatuh pada 12 November 2008 di batalkan. Pihak polis turut memberi amaran bahawa tindakan tegas termasuk penahanan akan diambil sekiranya upacara keagamaan tersebut diteruskan.

12. Tanggal 15 Disember 2008, sejumlah lebih 50 penunggang basikal yang menganggotai delegasi kempen Rakyat Pengayuh Perubahan anjuran JERIT telah ditahan pihak polis di sekatan jalan di Rawang, Selangor, kira-kira jam 1700H. Mereka kemudiannya dibawa ke Balai Polis Rawang. Ketua Polis Selangor pada mulanya menegaskan bahawa kempen berbasikal tersebut diklasifikasikan sebagai sebuah perarakan haram. Peserta di bawah umur 18 tahun telah ditahan semalaman di balai polis walaupun mereka menyertai kempen dengan izin dan restu ibu bapa mereka. Rasional penahanan peserta muda tersebut yang diberikan oleh Ketua Polis Selangor adalah bagi mengelakkan eksploitasi peserta muda oleh pihak penganjur yang tidak bertanggungjawab. Ketua Polis Selangor turut menyatakan bahawa waris yang berkenaan telah dihubungi untuk membawa pulang anak dan jagaan mereka. Selain itu, Ketua Polis Selangor mendakwa, peserta muda yang ditahan, tatkala disoal oleh pihak polis, menyatakan bahawa mereka tidak mengetahui motif penyertaan mereka dalam kempen itu. Namun, kenyataan ini telah disangkal oleh penganjur kempen yang membidas dakwaan Ketua Polis Selangor dengan menyatakan bahawa peserta muda yang ditahan sebenarnya enggan bekerjasama dengan pihak polis dan tidak menjawab pertanyaan yang diajukan memandangkan penahanan mereka adalah menyalahi undang-undang. Selain itu, ibu bapa peserta muda tersebut menempatkan waris mereka di bawah jagaan penganjur kempen JERIT bagi meneruskan kempen tersebut, sejurus selepas menuntut waris mereka dari tahanan pihak polis.

13. Ketua Polis Selangor telah dilaporkan dalam media membuat kenyataan bahawa pihak polis tidak membenarkan perhimpunan awam di ruang terbuka dengan menggunakan risiko keselamatan sebagai alasan. Sebaliknya, perhimpunan sedemikian rupa adalah lebih afdal di laksanakan di ruangan tertutup seperti di dalam sebuah dewan misalannya. Merujuk kenyataan tersebut, perlu deteliti bahawa polisi pihak polis ini:-

i) bukan sahaja mencabul hak yang secara jelas dijamin menurut Perkara 10 (1) (b) Perlembagaan Persekutuan, yakni, kebebasan untuk berhimpun secara aman dan tanpa senjata, malah boleh dilihat sebagai penyalahgunaan kuasa yang diamanahkan di bawah Seksyen 27, Akta Polis, 1967; dan

ii) adalah tidak konsisten dengan polisi pihak polis di Kuala Lumpur dimana perhimpunan pro-ISA di hadapan Sekretariat Majlis Peguam pada 1 Disember 2008 berlangsung tanpa sebarang campur tangan pihak polis walaupun kehadiran pihak polis jelas dilihat di lokasi tersebut.

iii) dari pelaksanaannya adalah tidak konsisten sama ada dengan, mahupun tanpa keterlibatan kerajaan Selangor, di mana polisi pihak polis ini tampak hanya sah dilaksanakan apabila sesebuah inisiatif itu dipelopori oleh individu atau kumpulan yang dilihat sebagai menyokong Polisi No to ISA kerajaan Selangor atau tatkala memperoleh sokongan kerajaan Pakatan Rakyat bagi sebarang usaha anti ISA yang lain. Dalam konteks ini, perkara berikut perlu di ambil maklum:-

a) Pada 12 Ogos 2008, seramai hamper 400 mahasiswa dan mahasiswi Universiti Teknologi Mara (UiTM) telah berarak ke pejabat Menteri Besar Tan Sri Khalid Ibrahim dan mengadakan demonstrasi yang turut melibatkan siswa-siswi tersebut melaungkan slogan mengutuk cadangan yang dikemukakan oleh Menteri Besar bagi memperuntukkan sebanyak 10\% kerusi UiTM bagi siswa-siswi bukan bumiputera dan juga warga asing. Adalah tidak diketahui sama ada permohonan permit polis dilakukan, dan jika permohonan tersebut dilakukan, adalah tidak diketahui jika permohonan tersebut diluluskan.

b) Pada 16 November 2008, satu perarakan pro-ISA, lengkap bersama kain rentang dan kemeja t yang mempamerkan slogan yang mencerminkan pendirian peserta perarakan terhadap ISA, telah dibenarkan mengambil tempat. Perarakan bermula dari Wisma Sejarah, Jalan Tun Razak dan berakhir di Balai Polis Jalan Tun Razak. Adalah tidak diketahui sama ada permohonan permit polis dilakukan, dan jika permohonan tersebut dilakukan, adalah tidak diketahui jika permohonan tersebut diluluskan. Pada petang hari yang sama, satu himpunan anti-ISA anjuran Gerakan Mansuhkan ISA yang jelas mendapat sokongan kerajaan Selangor dijadualkan mengambil tempat di Ampang. Perhimpunan anti-ISA tersebut telah diganggu dan dihalang oleh pihak berkuasa polis negeri, bersandarkan premis, permohonan permit polis bagi perhimpunan tersebut telah ditolak; dan

c) Sejak intimidasi dan gangguan pihak polis pada 9 November 2008, Himpunan Solidariti Anti-ISA PJ telah diteruskan pada setiap hari Ahad hingga kini. Walaubagaimanapun, lokasi perhimpunan ini telah ditukar ke perkarangan ibu pejabat MBPJ, Off Jalan Yong Shook Lin dan seorang ahli Majlis Bandaraya Petaling Jaya telah memohon dan mendapatkan permit polis. Namun, pihak polis secara persis mengemukakan syarat-syarat yang sememangnya jelas bertujuan menggagalkan program anti-ISA ini di mana antara lain, syarat yang dikenakan turut merangkumi: larangan terhadap pemakaian kemeja-t berslogan anti-ISA; larangan sebarang ucapan berbaur semangat anti-ISA; larangan penyalaan lilin sebagai tanda solidariti.


JUSTERU ITU, PATIK, SEKALIAN RAKYAT DENGAN INI:

14. menegaskan bahawa kami telah hilang keyakinan terhadap kemampuan Ketua Polis Selangor Dato Khalid Abu Bakar dalam menjalankan tugas dan menggunakan kuasa yang diamanahkan terhadap beliau mengikut undang-undang secara adil dan saksama, tanpa sebarang prejudis di samping tidak meneruskan usaha beliau dalam melemahkan dan menjejaskan Polisi No to ISA kerajaan Selangor berserta sebarang inisiatif penduduk dalam menyokong polisi tersebut;

15. memanjatkan doa dan memohon perkenan agar Duli Yang Maha Mulia Sultan Selangor berkenan

i) mengarahkan kerajaan negeri Selangor Darul Ehsan untuk membuat aduan kepada Suruhanjaya Pasukan Polis berkenaan perlakuan serta tindakan Ketua Polis Selangor Dato Khalid Abu Bakar seperti yang telah dijelaskan dan, sekiranya dirasakan sesuai pada pandangan Tuanku, meminta Suruhanjaya Pasukan Polis mengambil tindakan tatatertib terhadap Ketua Polis Selangor Dato Khalid Abu Bakar seperti mana yang dirasakan wajar di samping memindahkan Ketua Polis Selangor Dato Khalid Abu Bakar keluar dari Selangor.

ii) mengarahkan kerajaan negeri Selangor untuk mengambil setiap langkah yang perlu bagi memastikan hak penduduk Selangor untuk berhimpun secara aman tanpa senjata, terpelihara.

English version

We, the undersigned, all Malaysians who ordinarily reside in the state of Selangor or who, whilst not ordinarily residing there, frequently enter the state of Selangor in the pursuit of our legitimate affairs, do hereby petition His Royal Highness the Sultan of Selangor, Duli Yang Maha Mulia Sultan Sharafuddin Idris Shah Alhaj Ibni Almarhum Sultan Salahuddin Abdul Aziz Shah Alhaj on the following matters of concern :

WHEREAS :

1. In the 12th General Elections on 8th March, 2008, the majority of the voters in the various constituencies in the state of Selangor voted for change in the political governance in the state.

2. In accordance with the wishes of the people of Selangor, His Royal Highness the Sultan of Selangor appointed a Mentri Besar and state executive councilors from the Parti Keadilan Rakyat, the Democratic Action Party and the Parti Islam SeMalaysia, now collectively referred to as the Pakatan Rakyat, to form the current Selangor state government.

3. The Selangor State Legislative Assembly, in May this year, approved a motion calling for the repeal of the Internal Security Act, 1960 ( hereinafter referred to as the ISA ) and for the immediate release of all detainees held at Kamunting, Perak pursuant to the ISA ( hereinafter referred to as the Selangor Governments No to ISA Policy ).

4. Consistent with the Selangor Governments No to ISA Policy, Mentri Besar Tan Sri Khalid Ibrahim :-

i) has committed the state of Selangor to provide financial and welfare assistance to families of those held under the ISA; and

ii) had, on 29th November, 2008, officiated the soft launch of the People the Force of Change campaign initiated by the grassroots coalition Jaringan Rakyat Tertindas (Jerit) in which some 150 cyclists would, from 3rd December, travel through the country in a ride of goodwill and promoting awareness of issues, including the need to repeal the ISA.

5. A significant number, if not most, of the residents of the state of Selangor and those who frequently visit the state of Selangor fully support the Selangor Governments No to ISA Policy and to this end had, on 12th October, 2008, 19th October, 2008, 26th October, 2008 and 2nd November, 2008 held candlelight vigils at the Dataran Petaling Jaya, Off Jalan Timur, all of which were well attended and at which peaceful calls were made for the release of all ISA detainees and for the repeal of the ISA ( hereinafter referred to as the PJ Anti-ISA Vigil ). At all of these vigils, plainclothes police officers were in attendance, but at no time whensoever were there any orders from the police for these vigils to be ended nor had there ever been a direction from the police to apply for a permit as a prerequisite for the holding of any of these vigils.

AND WHEREAS IT IS NOW ACKNOWLEDGED THAT:

6. Malaysia is a federation wherein executive powers are constitutionally divided and demarcated between the federal government, on the one hand, and the governments of the 13 states that make up the federation, on the other.

7. Pursuant to Article 80(1) and the 9th Schedule, Item 1, List 3 of the Federal Constitution, internal security, including the police force, are matters within the purview of the federal government.

8. Pursuant to Article 140 of the Federation Constitution, the Police Force Commission thereby established is responsible for, amongst others, the appointment, confirmation, promotion, transfer and exercise of disciplinary control over members of the police force, all of whom are, pursuant to section 13 and the 2nd Schedule of the Police Act, 1967, required, on first joining the police force or before entering on the duties of their office, to declare on oath to obey, uphold and maintain the laws of Malaysia and to execute the powers and duties of their office honestly and diligently.

AND WHEREAS IT IS NOW NOTED WITH REGRET THAT:

9. the police authorities in the state of Selangor, led by the CPO Dato Khalid Abu Bakar have, by their conduct of late, shown themselves to have taken a position adverse to any and all efforts to make the repeal of the ISA a reality and, to this end, have conducted themselves with the clearest intent to undermine the Selangor Governments No to ISA Policy and to thwart the peoples support for the same.

i) On 9th November, 2008, a PJ Anti-ISA Vigil was scheduled to take place at the same venue as the earlier vigils, in collaboration with an initiative to commemorate the first anniversary of the BERSIH rally that took place in Kuala Lumpur on 10th November, 2007. On that evening, police, with the attendance of the Selangor CPO, ordered that the vigil disperse as there was no application for a police permit. Those who were present initially retreated into the Amcorp Mall close by. However, by about 9.45pm, after having sung the National Anthem, the attendees dispersed. Some, though, re-grouped at the park just in front of the MBPJ headquarters off Jalan Yong Shook Lin for what turned out to be an unplanned and impromptu second vigil. After some short speeches and whilst the Negaraku was being sung, without any warning or order to disperse, police officers under the charge of the Selangor CPO charged the vigil, injured some, and arrested 23 individuals.

ii) In the days after the disrupted PJ Anti-ISA Vigil, the Selangor CPO was reported in the media to have :-

a) alleged that the vigils on 12th October, 2008, 19th October, 2008, 26th October, 2008 and 2nd November, 2008 proceeded without heeding police demands to apply for a permit;

b) alleged that in the vigils on 12th October, 2008, 19th October, 2008 and 26th October, 2008, those in attendance dispersed upon being ordered by the police to do so;

c) alleged that those gathered at the Amcorp Mall on 9th November sang the Negaraku about three or four times, that each time police told them to disperse at the Jalan Timur field, those gathered would re-group, and that the national anthem was sung to try and keep the police at bay;

d) denied that police moved in on those present at the second vigil whilst they were in the midst of singing the Negaraku; and

e) alleged that those present at the second vigil were first asked to disperse before some were arrested.

10. The matters alleged by the Selangor CPO as narrated in 9 (ii) above are patently untrue and run counter to the videographic and photographic evidence as well as the eye-witness accounts of those who were in attendance at both the Amcorp Mall as well as at the second vigil.

11. The Hindu community in Hulu Selangor who have, since the detention of the five leaders of the Hindu community who have now come to be referred to as the Hindraf 5, been praying during the monthly Pournami Pooja prayer ceremony for the release of the five leaders were told by the Selangor police on 10th November, 2008 that the prayers for that month, scheduled for the 12th, could not proceed and that if the police directive was defied, action, including arrest would be taken.

12. On 15th December, 2008, more than 50 JERIT cyclists participating in the People the Force of Change campaign were stopped by the Selangor state police at a roadblock in Rawang, Selangor at about 5pm. They were later all taken to the Rawang police station. The Selangor CPO in the first instance contended that the campaign constituted an illegal procession. Cyclists below the age of 18 years, although participating in this initiative with parental consent, were held overnight at the police station. The reason for this action as proffered by the Selangor CPO : to save under-aged cyclists from being misused and exploited by the irresponsible organizers and that police had contacted the parents of the under-aged cyclists to take them home. The Selangor CPO alleged that when these young cyclists were questioned by the police, they said they did not know why they were asked to participate in the event. This has since been denied by the campaign organizers, who have countered that the young cyclists refused to say anything to the police officers as they did not want to cooperate with the police as they were being detained illegally. Yet the parents of these young cyclists, after removing them from the custody of the police, promptly returned them to the care of the Jerit campaign organizers to continue with the campaign.

13. The Selangor CPO has been quoted by the media as having stated that police do not allow open air gatherings for reasons of safety, preferring instead that such gatherings take place in an enclosed area like a hall. In relation thereto, it is noted that this stated policy of the police:-

i) violates the clear guarantee under Article 10 (1) (b) of the Federal Constitution to assemble peaceably without arms and to that extent, would constitute an improper exercise of powers conferred under section 27 of the Police Act, 1967;

ii) appears to be inconsistent with the policy of the police in Kuala Lumpur, as evidenced by the gathering of a pro-ISA assembly outside the Bar Council secretariat on 1st December, 2008 which proceeded unhindered notwithstanding the presence of police personnel in the immediate vicinity of that assembly; and

iii) appears to be applied inconsistently within and without the state of Selangor, the condition seemingly applying only where it involves initiatives by those seen as supporting the Selangor Governments No to ISA Policy or having the support of the Pakatan Rakyat state government in any other anti-ISA initiative. In this regard the following are noted:-

a) on 12th August, this year, about 400 students from Universiti Teknologi Mara (UiTM) marched to the office of Mentri Besar Tan Sri Khalid Ibrahim and staged a protest there, with protesters shouting slogans, condemning the suggestion by the Mentri Besar to allocate ten percent of the seats at UiTM to non-bumiputera students and foreigners. It is not known if a police permit was sought and, if so, one was approved;

b) on 16th November, 2008 a pro-ISA procession, complete with banners and t-shirts bearing slogans that reflected their stand on the ISA, was permitted to take place from Wisma Sejarah, Jalan Tun Abdul Razak, to the Jalan Tun Abdul Razak police station, whereafter a pro-ISA assembly was permitted to take place outside that police station. It is not known if a police permit was sought and, if so, one was approved. That same evening, an anti-ISA rally organized by Gerakan Mansuhkan ISA and which clearly had the support of the Selangor state government and was scheduled to take place in Ampang, was disrupted by the state police authorities on the stated grounds that the application for a police permit was disapproved; and

c) since the disruption of the vigil on 9th November, 2008, the PJ Anti-ISA Vigil has continued every Sunday up to the present. However, the location of these vigils have since moved to the tarmac in front of the MBPJ headquarters off Jalan Yong Shook Lin and to facilitate the same, a Petaling Jaya city councilor has dutifully applied for and obtained a police permit for the same. The police have, however, consistently imposed conditions that are plainly intended to frustrate this anti-ISA event : no t-shirts bearing anti-ISA slogans; no anti-ISA speeches; no lighting of candles in solidarity of this effort.

WHEREFOR WE THE UNDERSIGNED NOW:

14. declare that we have lost all confidence in CPO Dato Khalid Abu Bakar to carry out his duties and exercise the powers conferred on his office in law impartially and without continuing in his efforts to undermine the Selangor Governments No to ISA Policy and the efforts of the people of Selangor in supporting the same;

15. pray that His Royal Highness the Sultan of Selangor may be moved to

1) direct the Selangor state government to lodge a complaint with the Police Force Commission in relation to the conduct of CPO Dato Khalid Abu Bakar as hereinstated and, if thought appropriate, to request that the Police Force Commission take such disciplinary measures against the CPO Dato Khalid Abu Bakar as the Police Force Commission thinks fit but, in any event, to transfer CPO Dato Khalid Abu Bakar out of Selangor;

2) direct the Selangor state government to take all necessary steps to protect the right of the people of Selangor to peaceably assemble without arms.
