.DEMONSTRATIONS IN THE VICINITY OF PARLIAMENT

From 1 August 2005 the Serious Organised Crime and Police Act 2005 comes into force. Part of this Act will give Police powers to deal with demonstrations in the designated area.

For the purpose of this, a demonstration means a static protest/picket only and does not apply to marches.



2.DESIGNATED AREA

The boundaries are Hungerford Bridge, Blevedere Road, Lambeth Palace Road, Lambeth Bridge, Thorney Street, Horseferry Road, Strutton Ground, Broadway, Queen Anne's Gate, Birdcage Walk, Horseguards Road,The Mall, Northunmberland Ave.



3.S133 APPLICATION

All demos in the area MUST be authorised by the Police.

a) Not less than 6 days before the day on which it is due to start or,

b) if not reasonably practicable, then as soon as it is, and in any event NOT LESS THAN 24 HOURS BEFORE THE TIME IT IS DUE TO START



4.WHO APPLIES

If more than one person, any of the persons organising it,

If by a person by himself, then by that person.



5.INFORMATION TO BE PROVIDED

The written notice MUST provide:

a)Date and time of start

b)Location of the demonstration

c)How long it is to last

d)Whether to be carried on by a person by himself or not

e)Name and address of applicant



6.DELIVERY

Written application MUST be given by:

Delivery to a Police Station within the Metropolitan Police Area

Sent by Post by RECORDED DELIVERY to such a Police Station



7.S134 AUTHORISATION

If the application is recieved as specified above ie at an MPS Police Station in time

Police MUST give authorisation for that demonstration, However, we may impose conditions on the organiser, or particpants for the purpose of preventing:

REASON FOR CONDITIONS

a)Hindrance to any persons wishing to enter or leave Parliament

b)Hindrance to the operation of Parliament

c)SERIOUS public Disorder

d)SERIOUS damage to property

e)Disruption to the life of the community

f)A security risk in any part of the designated area

g)Risk to the safety of the public including participants in the demonstration



SPECIFIC CONDITIONS

a)Place where demonstration may/may not be carried on

b)Times

c)Period of time

d)Number of Participants

e)Number and Size of Placards banners used

f)Maximum permissible noise levels



NOTIFICATION TO APPLICANT

An officer of Superintendent Rank at CO11 Westminster must give notice to the applicant in writing of

a) The Authority

b) Any Conditions imposed



S132 DEMONSTRATING WITHOUT AUTHORITY IN DESIGNATED AREA

Any person who without authority:

a) organises a demonstration in the designated area, or

b) takes part in a demonstration in the designated area, or

c) Carries on a demonstration by himself in a public place in the designated area, commits an offence

DEFENCE

If person accused can show that he reasonably belived that authorisation had been given



S136 POWER OF ARREST

A Constable in uniform may arest without warrant anyone he reasonable believes is committing an offence under S 132(1)(a)(b) or (c)



S134 FAILING TO COMPLY WITH CONDITIONS

Each person who takes part in or organises a demonstration in the designated area is guilty of an offence if:

a) He knowingly fails to comply with a condition which is applicable to him

b) He knows or should have known that the demonstrations is carried on otherwise than in accordance with the particulars set out in the authorisation



S136 POWER OF ARREST

A Constable in uniform may arrest without warrant anyone he reasonably believes is committing an offence under S134(7)

DEFENCE

It is a defence to show that the failure to comply, or the divergence from the particulars arose from circumstances beyond his control, or from something done with the agreement, or by the direction of a Police Officer.
