On Sunday April 22, 2007, the 103rd Precinct of New Yorks all too familiar law enforcement division were the culprits in the victimization of three African American citizens; one being an active Staff Sergeant of the Armed Forces CECOM, LCMC Unit in Fort Monmouth NJ. Claiming to be one out of sixteen alleged non-emergency sectors in the Queens Borough area of New York, lead officer Perrone negligently responded to a dispute call that initially involved the aforementioned Staff Sergeant, Erica A. Dazle and two unidentified females.

Having to fend off an unjust attack instigated by the two unidentified females while in front of her 3 and 4 year old son and grandson respectively, Staff Sergeant Dazle was subsequently forced to rely on her teenaged son, Tyrone Dazle, son-in-law James Blevins, and then pregnant daughter Ruth Lambert-Blevins for assistance in the inequitable, physical assault, unexpectedly brought upon her. Once on the scene, lead Officer Perrone along with a significant amount of police backup, without delay diffused the situation with brute force before adequately assessing the entire scene.

Relying on the weighted explanation of the two unidentified females previously implicated in the altercation, Staff Sergeant Dazle, Mr. Blevins, and Mr. Dazle, a minor, were each viciously handcuffed without proper clarification or affirmation of their Miranda Rights; a direct violation of the U.S. Constitutions Fifth Amendment Law. After eight officers piled up on and beat Mr. Blevins unmercifully for purportedly resisting arrest, Staff Sergeant Dazle and son Mr. Dazle were the next to be thrown in the back of separate squad cars and refused medical attention from the scuffle, only to be booked at the 103rd Precinct in Queens and charged with second and third degree assault in addition to resisting arrest.

As a result of the police brutality received, Staff Sergeant Dazle suffered a dislocated shoulder and two fractured fingers to compliment Mr. Blevinss fractured left arm, deep gouges and cuts on his knees, hands, and feet, to go with the marks on his upper torso and facial area that neither brandished before the arrival of the control unit; putting Officer Perrone and team in direct violation of these victims Fourteenth Amendment rights to due process; the Eighth Amendments forbiddance of cruel and unusual punishment, followed by the unlawful use of excessive force that protects them through the Deprivation of Rights Under Color of Law, Title 18, U.S.C., Section 242.

It is deeply suggested that due to the NYPDs previous track record that this travesty of justice be looked into instead of looked over, and swept under the rug of unimportance as have a great number of cases in the New York region; which is why most recently, the New York Civil Liberties Union has released a 63-page report that questions the Civilian Complaint Review Board's handling of NYPD brutality allegations. In this petition, our goal is to institute a unified front in an effort to reestablsh the evenhandedness promised to us under the constitution of our nation, because where there is no justice, there can be no peace.
