Victim's Mother Demands Change to No-fault Insurance

On February 8, 2005 at 8:30 A.M on Notre Dame Avenue in Winnipeg, Manitoba, Canada. Oscar Vong, a 20 year old third-year student in the University of Manitoba's faculty of science, was walking to his job as an immunology researcher in a university medical lab at Health Sciences Center when he was struck by a local Duffys Taxi diver.

My son was walking on the way to Health Science Center in the middle of the cross walk. He was hit by a Duffys Taxi driver who did not even recognize that he hit my son and did not stop until a passenger told him about the accident. The taxi driver told the Winnipeg Police that he was mistaken to believe that he drove through the snow bank and because of the bright sun light, he was unable to recognized any thing . Says Mrs. Vong, a mother of the deceased.

CANNOT SUE DRIVER

She said the $10,800 she was given from Autopac -- plus $6,000 for funeral expenses -- is an "insulting offer" for her son's life. And under the no-fault system, she cannot sue the driver of the vehicle that fatally struck her son.

After the insulting offer by Manitoba Public Insurance the taxi driver got away cleans with no charges laid and currently still driving. I cant believe the Manitoba Public Insurance think our precious human life worth $10,800 and the last time I checked we are Priceless! If it happen to their own family member it would be a different story. It also shows our system is flawed and those who are criminally minded would use the same excuse to get away of murder.

Sounantha Vong, 51, has gathered about 5,000 signatures on a petition she's been circulating since March, 2005 is calling for the abolition of no-fault injury insurance.

She has raised questions to the Manitoba Public Insurance and did not get a respond from them.

1. Why is the speed limit on the street need to increase to 60km/hr?

2. Why did the experienced taxi driver who is familiar with the geographic as well as the road condition did not wear sunglass?

3. Why the taxi driver was not able to recognize the pedestrian walking on the street?

4. Why is the taxi driver after the accident still allow to drive the car?

5. Why the victim and his family members are deprived of their legal right to seek justice?

6. Why Manitoba Public Insurance would offer such Insulting Offer to each parent for $10,800.00 according to the book? Your twenty year old son worth $10,800.00 which is a BIG JOKE! I guess their children worth $10,800.00 too.

We need your help to change our system that would work for us/everybody.

1. Phone your MLA in your area and tell him/her what has to be done.
