Maltreatment of soldiers by the U.S. Army sign now

PETITION FOR U.S. CONGRESS TO THE SECRETARY OF THE ARMY OVER THE MALTREATMENT, FRAUD AND ABUSE OF ANDREW CURTISS.

This is to petition the decision made by the Secretary of the Army to Separate Andrew Curtiss from the Army involuntarily under false pretenses. The decision resulted in the erroneous discharge for General under honorable conditions of Andrew from the U.S. Army and a debt that exceeds 30,000 dollars in U.S. currency. This decision was made by the Secretary of the Army May 9, 2007 after over a year of deliberation. The discharge that Andrew is given is not punitive; but a discharge for the convenience of the Army. This Chapter of separation was requested by General Moholland U.S. Army Special Forces commander after Andrew was retained for service in a separation board convened, by the members of his own choosing. After the board was convened and Andrew was retained for service and all of his rights and privileges were restored; General Moholland was infuriated and immediately drafted paperwork requesting a rare chapter of separation from the military; a Chapter 5-3 for the convenience of the Army.

The Legal staff of the 3rd Special Forces Group included a list of charges in the reasons for separating Andrew Curtiss. In that list of charges which were being passed off to the Secretary of the Army as if Andrew were convicted of them; were charges that Andrew was found not guilty of in a military Court Martial. The legal staff even went as far as placing a conviction from another individual as a sexual offender in the list of charges. The legal staff from 3rd Special Forces also posted accusations that Andrew had stolen government property and posed the unproven and erroneous accusations off to the Secretary of the Army as charges. The 3rd Special Forces Group also failed to mention to the Secretary of the Army; that Andrew was not able to enter Fort Bragg NC as ordered by a Federal Judge, because of a history of reprisals and suspicious activity conducted towards Andrew by his command, the 3rd Special Forces Group. Instead the 3rd Special Forces Group legal Staff told the Secretary of the Army that Andrew was not allowed on Ft. Bragg as part of some Federal conviction sentence.

The reality of this situation was that Andrew would be allowed to enter Ft. Bragg and go back to active duty if he was allowed by the Army to do so with no further reprisal. The fact of the matter is that the 3rd Special Forces Group denied custody of Andrew and refused to stop reprisal by adverse action. Andrew was in a pay status agreed between his legal counsel and the 3rd Special Forces Group in that his place of duty was to report in daily by telephone to the senior Non Commissioned Officer of his Battalion. After over 18 months of being in that status and after the Secretary of the Army agreed to the separation chapter under false pretenses. It was deemed that Andrew be involuntary separated in a non punitive discharge and be paid a separation severance. It was as then members of the 3rd Special Forces Group retroactively falsified a DA Form 31 Document stating that Andrew was held in a status of Involuntary Excess leave for over 18 months. The legal Staff also used this fraudulent form to put Andrew in this Involuntary leave (No Pay Status) to discharge him from the Army without his knowledge and place him in a status of debt to the Army for more than 30,000 dollars. By the time Andrew was made aware it was too late.

The aforementioned information was the result of over two years of reprisals towards Andrew for notifying a Congressman over the abuse and Maltreatment that he and at least two other soldiers were undergoing as subordinates of the 3rd Special Forces Group. Andrew was recommended for the Silver Star in combat and awarded the Bronze Star with a V device for uncommon valor. This petition is also requesting that Andrew is relieved of his debt, is paid his severance and discharged Honorably, as his service was honorable.
