We the undersigned wish to draw to your attention to situation of the family law courts regarding the treatment of children whose parents are divorcing or separated. The experience of many such young people is that family law treats them as a possession to be equally divided between parents. Although their views are ostensibly supposed to be considered, in reality this does not happen, as many of us know only too well, and nowhere is this more keenly felt than in the area of enforced contact. The latest addition to the canon of family law, that of the principle of 'presumption of shared residence', epitomises the treatment of children as possessions. The justification for this is the psychological benefit to the child of contact with both parents, but all too often children are forced into contact with a parent they do not wish to see and and of whom they are often afraid. The presumption of shared residence can only exacerbate this situation.





We call for a genuine voice to be given to children of divorcing parents in that they may be freely allowed to express their own views and feelings and for these views and feelings to be genuinely heard and respected. Children are not possessions to be divided up and shared out in equal proportion. Children need a stable base and they need contact on their own terms. The enforcement of anything else is both damaging and abusive.
