STATEMENT OF SUPPORT TO THE JUSTICE FOR NICOLE, JUSTICE FOR OUR NATION CAMPAIGN OF THE TASK FORCE SUBIC RAPE (TFSR)



As we come to a critical stage in ensuring that

justice be served in the trial of the U.S. servicemen

accused of raping a Filipina, we wholeheartedly

commend the victim Nicole for gathering courage to

defend her dignity and demand justice for herself and

our nation.



We believe that the Subic rape case is a landmark

case for being the first that has come to trial in

our country against U.S. servicemen and for its

importance in challenging the implementation of the

Anti-rape Law in the furtherance of womens rights.



It is frustrating indeed that DOJ Sec. Raul

Gonzales, sworn in to fight for the victim on behalf

of the Filipino people, .consistently issued

statements inimical to the case such as downgrading

the case of three US Marines, stating that Nicole has

merely imagined the prosecutors incompetence just as

she just imagined being raped and its refusal to

change the prosecutors.



We denounce the lead state prosecutors acts of

selling out the case by brokering a deal for Nicole to

withdraw her case in exchange for the acquittal of

the U.S. Marines.and the DOJs refusal of her request

to change the prosecutors.



We support Nicole and her family in their refusal

to take part in the trial due to absolute loss of

trust and confidence on the state prosecutors who were

incompetent, irresponsible , selling out the case and

who at the crucial stage of the trial refused to

let her private counsel cross examine the accused

U.S. Marines.



We believe that the Subic Rape Trial confronts the

one year limitation for trial in our courts imposed

by the Visiting Forces Agreement that at the outset

has denied a fair trial for Nicole.



We once again renew our call for the scrapping of the

Visiting Forces Agreement not only for its lack of

respect to our laws as a sovereign nation but also for

its being an instrument of war and obstacle in the

promotion of peace.



We firmly believe that the ultimate judge of this

case will be no less than the Filipino people in their

aspirations for justice and sovereignty and by the

international communitys solidarity to our common

endeavors for peace.



We, the undersigned, therefore, call on the Filipino

people and the international community to rally

behind Nicole who as a rape survivor is fighting not

only for herself but for the dignity of all Filipinos

and for the sake of Filipino women and men who are at

risk from various types of abuse due to the Visiting

Forces Agreement.
