A PETITION,

TO Mr. Caleb Root, President of the Hartwick College Student Senate,

AND TO Ms. Melissa Swaby, Vice President of the Hartwick College Student Senate, Ms. Emily Frankel, Vice President of Finance, Ms. Dorienne Rosenberg, Vice President of Senate Affairs, the Hartwick College Student Senate, and the Hartwick College Student Senate Executive Board,

AND TO Mr. Dick Miller, President of Hartwick College College, Mr. Greg Krikorian, Vice President of Student Life, Ms. Nanette Spedden, Director of Student Activities and Community Service, Mr. Robert S. Hanft, Chairman of the Board of Trustees, and the College Board of Trustees,

BEFORE all members of the Hartwick College community



WHEREAS, all of the Hartwick College student body are charged $100 per semester in activity fees, to be used for the benefit of the entire community;

WHEREAS, the Student Senate has chosen to spend a portion ($4,000 in total) of this money on the compensation of their own Executive Board, obscured under the name of the Pardez resolution and attached to unrelated legislation relating to financing of clubs;

WHEREAS, the Student Senate makes no provision for the compensation of other student leaders, whose contribution to the community may equal or even exceed their own;

WHEREAS, it is the right of Hartwick College students to determine how the moneys that they are charged under the name of student activities fees are spent, and the determination by the Senate of the compensation of their own members constitutes a conflict of interest;



IN ORDER TO eliminate any appearance of such as conflict of interest;

AND TO promote accountability for members of the Student Senate;

AND TO equalize the possibility of the provision of compensation among all student leaders, in recognition of their service to the community;





We, the undersigned, hereby submit the following



as a petition pursuant to the bylaws of the Hartwick College Student Senate, Article VIII, section 1, para. 8, in accordance with the terms of the Constitution of Hartwick College Student Senate, Article IV, Section E, immediately upon the acquisition of one hundred and fifty signatures on this document, and, should the number of undersigned exceed one-quarter of the student body, as legislation for the ballot under Article IV, section F, as legislation to be placed on the ballot of the following semester. Entitled,



A PETITION FOR FAIRNESS AND ACCOUNTABILITY

IN COMPENSATING STUDENT LEADERS



ARTICLE I, establishing referenda concerning the compensation of student leaders,

(a) Notwithstanding any resolution of the Student Senate, any decision relating to the compensation of Student Senate executive board members, Senate members, other student organization officers or members, or any member of the student body, with funds allocated to the Student Senate, Student Union, or any other student organization, shall be decided by a special referendum of the entire student body. (b) Such a referendum will be void without the participation of three-quarters of the student body. (c) This article shall not be construed to control any compensation relating to work study or campus employment. (d) Such referenda shall not be considered legislation before the Student Senate as described in the Senate Constitution, Article IV, sections E and F.

ARTICLE II, concerning the conduct of said referenda, (a) Such a referendum will be publicized by a system-wide e-mail, by signs prominently posted around the campus, by letters sent to students campus mailboxes, and by tabling outside of the Commons. (b) Any student organization shall have the power to request a referendum as set out in Article I to request or change the compensation allocated to themselves or their executive board, without petition to the student community prior to the initiation of said referendum. (c) This article shall not be construed to control any compensation relating to work study or campus employment.

ARTICLE III, requiring referenda and regarding the disposition of compensation already allocated, (a) Notwithstanding any resolution of the Student Senate, no decision shall be made relating to the compensation of any member of any student organization, without a special referendum as set forth in Article I. (b) The authorization of the Student Senate or any other organization shall not be required before such compensation is instituted, provided that said compensation is instituted according to the provisions of Article I. (c) Any and all compensation to students for services rendered to the community in the course of their service as officers or members of a student organization in place of the time of the passage of this resolution shall be immediately deemed void pending the completion of a referendum under the terms of Article I. (d) This article shall not be construed to control any compensation relating to work study or campus employment.

ARTICLE IV, concerning petitions for referenda, (a) Notwithstanding any resolution of the Student Senate, a petition to suspend compensation may be made by any member of the student body, by a petition with the signatures of at least one-quarter of the student body, triggering a special referendum of the entire student body as set forth in Article I. (b) Such a petition shall include an explanation of the reason for the suspension sought, citing any misconduct or negligence on the part of those who would receive compensation, and specifically identify the organizations and individuals whos compensation is to be suspended. (c) Following the completion of such a petition, compensation will be suspended until the completion of said referendum. (d) Such petitions and referenda shall not be considered legislation before the Student Senate as described in the Senate Constitution, Article IV, sections E and F. (e) This article shall not be construed to control any compensation relating to work study or campus employment.

ARTICLE V, concerning disclosure of compensation to the student body, (a) Pursuant to Article VII, Section A, para. 9 of the Constitution of the Student Senate, information regarding the compensation paid to any student under the terms of these Articles will be distributed to all members of the Hartwick College community by e-mail and paper mail in their mailboxes at the start every semester and at every occasion when said compensation shall change. (b) Such mailing shall include an explanation of the process of petitions for suspension and for change of compensation. (c) This article shall not be construed to control any compensation relating to work study or campus employment, or any compensation paid by any company organization outside of the College.

DEFINITIONS. Student organization means the Student Senate, the Student Union, any Greek organization recognized by the College, and any student organization recognized by the Student Senate or Student Union, or any other student-lead organization receiving funds from or officially recognized by the College. Compensation means money paid to a member of such an organization for their services rendered to that organization, and shall not be construed to mean any money paid via work study or campus employment for the rendering of services to the community through work study or campus employment recognized and offered by the College. Student body means all full-time students presently enrolled in the College. Referendum means a vote of the entire student body, to be conducted by secret ballot, either on paper, or on computers. Such a vote shall be secure against tampering and shall be counted by neutral parties. Petition means a petition written by any member of the student body, with signatures of a given number of members of the student body attached, along with verifiable contact information, submitted to the President of the Student Senate.
