In exercising our First Amendment right to petition the government, we, the concerned citizens of Bangladeshi descent, are profoundly dismayed by a recent event that has resulted in the arrest and confinement by the United States Immigration Services (USIS) of a member of our community, Md. Mustafizur Khan. Md. Khan is a hard working, law-abiding, tax-paying family man. He has been living in Reno for the past twelve years. He is married to Naima Sultana Khan, a United States citizen. They have a child together, Sara Zarin Khan, who will be two in a few days. The family was planning on celebrating their daughters second birthday on December 4th. This birthday-celebration is on hold while the family is trying to survive this ordeal with USIS due to Mr. Khans arrest. He is a good father, an excellent husband and a great community member who tries his best to provide for the family and contributes a lot to the community. Mr. Khan is a person of very modest means and cannot afford high-priced attorneys to secure his release. His family needs your humanitarian help.

Mr. Khan petitioned for political asylum in fear of being prosecuted by the government of Bangladesh because of his political affiliation with a party in
Bangladesh whose founders were involved in the killing of the family of the current Prime Minister. His life is in danger because of his mere affiliation with the political party while he did not have any role in the killing of the family of the Prime Minister. The deportation proceeding that is currently underway is alarming and needs intervention from your office which might result in his release and stopping the deportation process. Mr. Khan would be arrested as soon as he arrives in Bangladesh and would certainly be tried and might be hanged by vindictive-jealous government prosecution. He is not a criminal but he made a mistake of joining a political party whose founders were involved in committing a heinous crime by killing the ruling class family members. He has every right to join a political party of his choosing but that became the death-nail in his coffin. The killings of the ruling-class family members was a crime and lets not commit another by deporting Mr. Khan to a country where his life is very much in danger. Mr. Khan and his attorney were able persuade the judge to reopen his denied case based on evidence that Mr. Khans life is in danger if deported to Bangladesh. When Mr. Khan appeared in court, the judge changed his mind, and he was taken into custody, where he still remains.

We trust that you will immediately direct the USIS to re-evaluate the facts surrounding the arrest and detention of Mr. Khan and allow him to join his family and return to work where his financial-contribution is very much needed to support his wife and a small child.
