Fire Andrew Shirvell sign now

Since April 2010, Andrew Shirvell, Assistant Attorney General of the State of Michigan, has maintained the blog "Chris Armstrong Watch," a repulsive hate site singularly devoted to attacking the 21-year-old gay student-body president of the University of Michigan.

Shirvell's site, among other things, displays Armstrong's picture defaced by a rainbow flag and Nazi swastika and refers to Armstrong -- a college student -- as a "viciously militant" and "wild-eyed radical homosexual activist," a "racist liar," a "narcissistic little snot," a "very, very twisted sick individual," an "arrogant, self-absorbed psychopathic liar," a "perverted homosexual exhibitionist," and a "privileged pervert."

Shirvell's blog also obsessively tracks and analyzes Armstrong's conversations with friends and status updates on Facebook, discloses personal financial details about Armstrong's family (including the value of his parents' home and his father's employment), and makes recklessly false factual allegations against Armstrong -- including baseless claims that Armstrong "participates in" and "promot[es] . . . underage binge-drinking," that Armstrong "hosted a homosexual orgy at his dorm," and that Armstrong and engages in "dorm orgies, frequent casual gay sex, and quite possibly public sex acts in parks and at houses of worship."

Shirvell, according to his own admissions, has also physically stalked Armstrong off-line, actually lurking outside Armstrong's home and taking picture to post on Shirvell's disturbing blog.

Keep in mind that Armstrong is a 21-year-old college student (who was only 20 when Shirvell began his hate blog), and that Shirvell is not just an attorney and state official, but an Assistant Attorney General of the State of Michigan -- tasked with, among other things, protecting the public, safeguarding civil rights, and combating cyber-bullying and stalking. And all of this unhinged, obsessive, and bizarre behavior was provoked merely because Armstrong is gay.

Shirvell's behavior has created a national controversy. Yet, inexplicably, Shirvell's employer, Michigan Attorney General Mike Cox, has resolutely refused to terminate -- or even discipline -- Shirvell. Cox's excuse is that Shirvell's blog, created on his own personal time, is allegedly protected First Amendment activity.

This is simply not the case. The First Amendment does not protect false, libelous speech. Nor does it prevent a public employee from being fired if the employee's right to speak on a subject of public concern is outweighed by "the interest of the State, as an employer, in promoting the efficiency of the public services it performs through its employees." Pickering v. Board of Education, 391 U.S. 563 (1968). Even though Armstrong's presidency of the University of Michigan student body is a subject of "public concern," and Shirvell would have the right to criticize Armstrong in a mature and appropriate fashion, the libelous, personally threatening, and highly incendiary manner in which Shirvell -- a high-ranking public official -- has chosen to express his "opinions" undermines the Attorney General's mission and "the efficiency of the public services it performs through its employees." Shirvell's behavior, to say the least, calls into question his office's commitment to protecting young people from cyber-bullying and cyber-stalking and to safeguarding the civil rights of LGBT persons.

In summary, Attorney General Cox's First Amendment excuse simply does not hold water. Shirvell's continued employment as an Assistant Attorney General at the expense of the taxpayers of Michigan is an embarrassment and an outrage. He should be removed immediately.
