Driver Responsibility Assessment Program NYS sign now

This petition is against the driver responsibility assessment program. In addition to any fines, fees, penalties, or surcharges that you pay for a traffic conviction, you must pay the driver responsibility assessment. You pay the assessment to the DMV, which is a state agency.



You must pay the driver responsibility assessment if any of the following incidents occur:

- you receive six or more points on your driver record during a period of 18 months and the violations occurred on or after November 18, 2004.

- you are convicted of an alcohol-related traffic violation and the violation occurred on or after November 18, 2004 (includes boats and snowmobiles)

- you are convicted of a drug-related traffic violation and the violation occurred on or after November 18, 2004 (includes boats and snowmobiles)

- a DMV hearing determines that you refused a chemical test and the refusal occurred on or after November 18, 2004 (includes boats and snowmobiles)



If you receive six points on your driver record during a period of 18 months, the total assessment is $300. If you receive more than six points on your driver record during a period of 18 months, the total assessment is $75 for each additional point. (In other words you have to pay the fine for the ticket plus an additional $300 to the state even though there is already a surcharge by the state included with the fine when paying the ticket. If you recieved more than 6 points on your record you would have to pay the fine plus an additional $75 for every point over 6 points to the state.)



If you are convicted of a traffic violation that is alcohol-related or drug-related, or if you refuse a chemical test, the total assessment is $750. This is in addition to any fines, fees, penalties, or surcharges that you pay for a traffic conviction. (In other words you have to pay the fine for the ticket plus an additional $750 to the state even though there is already a surcharge by the state included with the fine when paying the ticket.)



The state already has a surcharge on fines which usually exceeds the actual fine itself plus this additional fee that you would have to pay. They claim that this program would help prevent aggressive driving within New York.



A study conducted by The Automobile Association, Group Public Policy Road Safety Unit - Britain has showed that environmental factors cause aggressive driving such as noise, temperature, overcrowding, and territoriality. Further studies also showed that congested roadways and pent-up frustration lead to aggressive driving as well as how you feel before you even start your vehicle has a lot to do with how stressed you will become while driving. How will increasing a fine help these factors other than place more stress on middle and low income families???



The majority of these incidents happened during the daylight hours (70\%) on a main road (not freeway or divided highway) which more likely means that people driving to and from work are being hit with this fine.



The study indicates that the focus of the traffic safety community should not be removed from areas such as alcohol and speed which are and continue to be significant causes of death and injury on the highway.

By placing this additional fine, New York State is simply targeting middle and low income citizens while high income citizens would simply pay the fine without thinking twice. The more appropiate alternative would be to have the person take a stress or anger management class after a certain number of offenses and if the problem persists have their license suspended. This seems to be more of a logical approach and would also represent equality which is what this country suppose to be based upon.
