Develop, Not Strangulate the Swiftlet Edible Birds' Nest Industry sign now

We, the undersigned view with alarm, the contents of the press statement by the Local Government Minister, Dato Seri Kong Cho Ha on the Swiftlet Industry Guidelines (1GP to the industry) in The Star 22/May/2010/Sun. The reported proposals are feared to be overly regulatory with hefty penalties, presumptuously prescriptive and strangling instead of being developmental, as the PM had stated as an executive intention, in his 2010 budget speech.

We call upon the Ministers instead, to :
(1) standardise and codify various existing state by-laws for easier compliance, along with transparent and consistent expectation;
(2) prosecute errant operators who have marred the reputation of the industry with impunity for breaches of such standardised by-laws;
(3) remove the relevant provision(s) giving overarching reach under the Wild Life Conservation Bill 2010, through the licensing of birds' nest harvesting and sale of the same of a non threatened specie;
(4) immediately make available to the public the contents of 1GP, and to name the past and present (if any) industry representative(s) for referral, continuity and going forward, future collective feedback to the authorities;
(5) seriously reconsider the unhealthy, regressive, innovation-killing, FDI-dissuasive and presumptuously prescriptive proposals, to control and license the whole supply chain for edible birds' nest;
(6) utilise the 2010 budget allocation wisely for value-added research on the apparent and worrying trend of diminishing 'carrying capacity' of specific geographical locations vis-a-vis habitat destruction of swiftlets' food sources;

Charges of unfair and overzealous past enforcements were attributed to non-uniformity and inconsistency in the interpretation of the various local by-laws, rendering them a hazy maze for compliance.

Past enforcements had resulted in the unnecessary destruction of thousands of swiftlet eggs, newly hatched swiftlets and fledglings. This seems likely to be repeated as a result of the new guideline stated by the Minister.

A gross injustice is about to be permitted and institutionalised, where a whole plethora of new regulations with uncertain and frivolous objectives are put in place, to regulate the conscientious majority, instead of penalising the errant few with breaches of existing by-laws.

We appeal that the industry be allowed to grow organically and not be smothered with unnecessary and misplaced 'assistance' coupled with severe penalties that unnecessarily make criminals of ordinary citizens

In the light of the precarious standing of our national finances and the dire need to enhance efficiency, let us not further pile on wasteful and costly bureaucracy.

Dengan perasaan bimbang kami rujuk kepada isi kandung akhbar oleh Menteri Perumahan dan Kerajaan Tempatan, Dato 'Seri Kong Cho Ha mengenai Garis Panduan Perusahaan Sarang Walet (juga dikenali 1GP) dalam akhbar The Star 22/May/2010/Sun. Cadangan yang dilaporkan amat membimbangkan kerana peraturan yang keterlaluan dan merangkumi seluruh industri sarang walit. Ianya dikhuatiri akan membebankan dan menyekat perkembangan industri burung waletyang masih baru. Bercangahan dengan visi YB Perdana Menteri untuk membangunkan industri sarang waletseperti yang dinyatakan pada belanjawan sesi tahun 2010.

Sebaliknya kami ingin mencadangankan supaya :
(1) menseragamkan undang-undang Pihak Berkuasa Tempatan yang sedia ada supaya mudah di-patuhi;
(2) membawa kemuka pengadilan pengusaha-pengusaha yang sekian lama telah mencemarkan nama baik perusahaan ini dengan undang-undang yang telah diseragamkan;
(3) menghapuskan peruntukan yang relevan (s) dibawah akta Wild Life Conservation Bill 2010, yang tidak ada kena mengena dengan spesis terancam. Ia nya akan menyekat perusahaan ini melalui sistem perlesenan pengutipan dan penjualan sarang spesis burung yang tidak terancam;
(4) meyebarkan isi kandungan 1GP, berserta nama dan wakil industri terdahulu dan terkini untuk rujukan, usaha lanjutan dan seterusnya timbal balik kepada pihak berkuasa;
(5) mempertimbangkan semula dengan lebih serius peraturan-peraturan yang tidak sihat, peningkatan, anti-inovasi, cadangan yang beralaskan andaian yang kurang tepat, demi untuk mengawal dan melesenkan kesemua rantaian bekalan sarang burung walet;
(6) memanfaatkan peruntukan kewangan 2010 dengan bijaksana melalui kajian tambah-nilai kemampuan lokasi tertentu menampung keperluan burung walet akibat pengurangan dan pemusnahan habitat sumber makanan burung walet';

Penguatkuasaan dimasa lalu di-dapati tidak adil dan tidak seragam kerana pentafsiran undang-undang tempatan yang tidak sekata serta menyukarkan pematuhan undang-undang tempatan.

Penguatkuasaan dimasa lalu juga telah mengakibatkan kerosakan pada ribuan telur, anak-anak burung yang baru menetas dan anak-anak burung yang masih kecil. Berkemungkinan besar perkara buruk yang serupa akan terjadi sekiranya garis panduan tersebut diterima.

Ketidakadilan akan terus berlaku apabila mereka yang bersalah tidak dihukum dengan undang undang yang sedia ada tetapi majoriti pengusaha dikekang dengan peraturan-peraturan baru dengan tujuan yang kurang jelas.

Kami merayu agar industri walet dibenarkan tumbuh secara organik dan tidak dikekang dengan peraturan yang kelebihan dan sia-sia.

Dimasa keadaan ekonomi yang meruncing kini, kita perlulah meningkatkan kecekapan. Bukan dengan memburukkan lagi keadaan melalui sistem birokrasi yang sia-sia dan mahal.

我们; 以下签署者的意见,针对关于登载在 STAR日报,五月22日2010年, 星期日, 燕窝行业规范(1GP 燕窝行业)由地方政府部长在新闻界发表声明的内容。该发表恐怕会过分规管, 超高额罚款和窒息燕窝行业的发展而不符合首相的2010年的财政预算案.

我们呼吁有关部长慎重考虑以下提意 :
(1) 规范和整理各种现有的国家法律规定,引用透明和一致的规条使它将会很容易遵守;
(2) 起诉那些破坏该行业声誉的业者,标准化合法的经营者;
(3) 删除以下有关条文,非受威胁品种燕窝采伐许可证以及销售非受威胁物种燕窝许可证, 总结野生动物保护条例2010;
(4) 立即向公众提供的1GP内容,以及推荐过去和现在(如有)行业代表,连续性发展,未来的集体反馈于政府机关;
(5) 认真考虑整体燕窝供应链中的不健康,倒退,扼杀创新,外国直接投资和劝阻擅自指令性建议,控制和许可证;
(6) 明智的运用2010年预算分配, 增加更多的研究, 如研究令人担忧某些燕子的食物来源和栖息地的破坏的对比趋势.

过去不公平的执法是由于法律非均衡性和各个地方的解释都不一致,所以使它存在一个膜糊的状态.

过去的执法已导致成千上万不必要的燕蛋和初孵幼鸟被破坏。这个新的指引似乎很可能导致历史重演.
