Delara Darabi and a 19-year-old man named Amir Hossein broke into a womans house to commit a burglary. They had no intention of killing anyone, only to steal to finance their marriage. The simple burglary turned tragic when the owner of the house turned up. Amir Hossein allegedly killed the woman owner/occupier of the house was killed during the burglary. Delara Darabi initially confessed to the murder, but has since retracted her confession. She claims that Amir Hossein asked her to admit responsibility for the murder to protect him from execution, believing that as she was under the age of 18, she could not be sentenced to death.

Delara Darabi was initially sentenced to death by a lower court in the northern city of
Rasht. The sentence has now been upheld by the Youth Court (Branch 107) in the same city. She maintains her innocence and claims that she was under the influence of
sedatives during the burglary. Delara Darabi was only 17 years of age at the time of the alleged crime.

Delara Darabi is an artist who has been painting since the age of four. Recently, an exhibition of her paintings she has done whilst in prison was staged in Tehran.

As a state party to the International Convention on Civil and Political Rights
(ICCPR) and the Convention on the Rights of the Child (CRC), Iran has
undertaken not to execute anyone for an offence committed when they were under
the age of 18. In January 2005, the UN Committee on the Rights of the Child urged Iran to immediately stay all executions of people convicted of crimes committed when they were under 18, and to abolish the death penalty in such cases. However, the regime continues such execution.

We undersigned appeal to the Islamic Republic of Iran to honour its commitment to the ICCPR and ICC, to which they are a state party.
We urge the authorities to ensure that the victims family is made aware of its right, under Islamic law, to request a pardon of the condemned.
We urge the supreme leader and the head of the judiciary to pardon Delara Darabi.
