Declaration of Independence from the BCS

That whenever any Form of Government becomes destructive of these ends, it is the Right of the People to alter or to abolish it, and to institute new Government (Declaration of Independence)

Government is defined as:
1. The office, function, or authority of a governing individual or body.
2. The agency or apparatus through which a governing individual or body functions and exercises authority.
3. A governing body or organization

The BCS can therefore be defined as a government that controls the authority over the current system for determining a National Champion for NCAA Division I College football.

But when a long train of abuses and usurpations (A wrongful seizure or exercise of authority or privilege), pursuing invariably the same Object evinces a design to reduce them under absolute Despotism (Rule by or as if by a despot; absolute power or authority), it is their right, it is their duty, to throw off such Government. (Declaration of Independence)

Abuses and Wrongful Exercise of Privilege

1. University of Auburn 2004 Finished the Season undefeated and Champions of the Southeastern Conference. Not invited to play for the National Championship.

2. University of California 2004 Finished the season with a higher BCS ranking than the University of Texas but was left out of the Bowl Championship Series.

3. University of Southern Cal 2003 Finished the season undefeated and did not play in the title game. Oklahoma lost the Big 12 Championship but still managed to be ranked above USC in the BCS. USC was only awarded a share of the National Championship by the AP Poll not the BCS.

4. Florida State University 2002 Finished the season ranked third in the BCS polls. They defeated the University of Miami which finished 2nd in the BCS rankings in a head to head competition during the 2003 season. A strong argument can be made that they should have been provided an invitation to the title game.

5. Tulane University went 11-0 during the 1998 season but failed to qualify for any of the BCS bowls. Tulane played in the Liberty Bowl, where it received millions less than it might have in a BCS bowl.

6. Division II college football and all other NCAA team sports use a playoff system to determine a National Champion. The BCS refuses to implement the same system used by all other NCAA team sports.

7. The use of polls without prior permission to help determine a champion. The AP Associated Press has informed the BCS to cease in using their poll as part of their mathematical computations.

8. Beginning in 2006, Notre Dame will earn an automatic BCS berth with a top-eight ranking in the final standings, Weiberg said. Also, under a new arrangement, Notre Dame is now guaranteed BCS money every season even when they don't play in a game. This is fair?

The Declaration of Independence has and can be used as a basis for law in previous court cases.

Supreme Court

Adarand Constructors v. Peсa, the 1995 government contracting case that called the constitutionality of affirmative action into serious question, Thomas invoked the Declaration of Independence as the rule of decision. He wrote, "There can be no doubt that the paternalism that appears to lie at the heart of this [affirmative action] program is at war with the principle of inherent equality that underlies and infuses our Constitution.
