Civil Rights in Christopher Columbus High School sign now

RECOGNIZING:
-the court rulings of Tinker v. Des Moines Independent Community School District (1969), Karr V Schmidt (1970), and Bethel School District v. Fraser (1986).
-The Studies from the books Effects of Student Uniforms on Attendance, Behavior Problems, Substance Abuse, and Academic Achievement: The Journal of Education Research (Volume 92, Number 1, Sept./Oct. 1998, pp. 53-62) (by David L. Brunsma, University of Alabama and Kerry A. Rockquemore, Notre Dame.), The Problems with School Uniforms (by R. Matthew Warner), and The dangers of the school uniform movement (by Gary Peter Klahr),
-An Unlimited amount of first hand observances from countless students and non-students that the lack of freedom has an overwhelming amount of negative effects



We find that the rules of the school are unconstitutional (through contract law or not), and wish that the administration of Christopher Columbus High School of Miami Florida (a Marist high school), Change the rules to Repeal the following restrictions:

1. Gender Segregation -
Separate but equal was the old court ruling from Plessy v. Ferguson that legalized Racial Segregation. But what about gender segregation, Different education for girls and boys?
Christopher Columbus High School and its sister school Our Lady of Lourdes Academy are perfect examples. By one point of view you can see them as one large (unconnected) school that is indeed segregated.
The point of a school is to educate and prepare for the life ahead is it not? Well where in our nation do you see somewhere were no one of the opposite sex is allowed? Most obviously it is not the most common thing now is it? One especially important place where that doesnt happen is in college (except some dorms, but no classes), which is what PREP school is Preparing us for is it not?
Another problem with it is that it promotes sexism. If you want an example, just look around the Columbus student body. The kids that CCHS is sending into the world are the same kids that refer to themselves as pimps and women as bitches and hoes; no matter how many lessons that teach against it in religion class you have, the kids are still like that. Are these kids the ones who should be leading the future?
Aside from that, a third problem with this is that is that there is a different education. Different schools have different teachers, (that is obvious), and lets say that a parent wants to send his daughter and his son to the best private school. If he lived here, he would find that he would have to split them between Christopher Columbus and Lourdes. Now, you cant have two thins without one being better than the other in some way: Better math teacher, better curriculum, better sports, better curriculum, better diversity of classes, ect. There is multitude of ways that Columbus might be better than Lourdes. Which one is better than the other I dont know, but the fact is that when you make it separate, it creates inequalities no matter how hard you try.
So there is a simple Solution that leaves nobody out in this, Open both schools up to the opposite sex, and naturally over a small amount of time Lourdes girls will go to Columbus( and vice versa [not to forget people from other schools]), and the student body will become equal in no time.


2. Uniforms -
Tinker v. Des Moines Independent Community School District (1969) Ruled that:
"First Amendment rights, applied in light of the special characteristics of the school environment, are available to teachers and students. It can hardly be argued that either students or teachers shed their constitutional rights to freedom of speech or expression at the schoolhouse gate. This has been the unmistakable holding of this Court for almost 50 years."
"The Fourteenth Amendment, as now applied to the States, protects the citizen against the State itself and all of its creatures - Boards of Education not excepted. These have, of course, important, delicate, and highly discretionary functions, but none that they may not perform within the limits of the Bill of Rights. That they are educating the young for citizenship is reason for scrupulous protection of Constitutional freedoms of the individual, if we are not to strangle the free mind at its source and teach youth to discount important principles of our government as mere platitudes."
"The District Court concluded that the action of the school authorities was reasonable because it was based upon their fear of a disturbance from the wearing of the armbands. But, in our system, undifferentiated fear or apprehension of disturbance is not enough to overcome the right to freedom of expression. Any departure from absolute regimentation may cause trouble. Any variation from the majority's opinion may inspire fear. Any word spoken, in class, in the lunchroom, or on the campus, that deviates from the views of another person may start an argument or cause a disturbance. But our Constitution says we must take this risk, and our history says that it is this sort of hazardous freedom - this kind of openness - that is the basis of our national strength and of the independence and vigor of Americans"
In short, this court decision ultimately ruled that freedom of expression applies to students in school. Many argue that the court decision applied to only public school, but through other laws of the late 20th century, it became proven that private schools are not above the law. (Example: Private schools are not allowed to beat students anymore), so why is it that Christopher Columbus (and many other private schools) is allowed to be ABOVE THE LAW?

Aside from (in theory outside of the CCHS contract law) unconstitutional, the uniform has negative effects on students mentally

3. The Haircut Policy -
Aside from the Uniform policy, the separate Haircut policy is equally mentally damaging.
The Above Studies and Court cases also apply to this argument, but (and to reduce redundancy) will not be repeated.
It is a separate policy from the uniform one, but has the same consequences. It can be considered "different" because it is more distracting, but hair is a simple thing, it can be slicked back, ironed, or whatever else it takes, but it SHOULDN'T HAVE TO BE SHORT.
