I submit as under:



That I withdraw my complaint with District Consumer Disputes Redressal Forum, Nawanshahr and submit the application before The Punjab State Consumer Disputes Redressal Commission, Chandigarh IN PUBLIC INTEREST.

That As I have not claimed any compensation from the respondents and my application is in public interest and for the benefit of Govt. exchequer so my fees for filing the application should be waived.

That I traveled yesterday by the bus in question yesterday. The bus No. is PB-02Y-9970. I boarded in that bus from Phagwara at 12:20 P.M. The bus reached at Nawanshahr at 1:20 P.M. The same routine. The bus halted at Nawanshahr for half an hour.

That the sign board displayed in the bus was though today up to the distance of Mohali, but the conductor was inviting the passengers to board for Chandigarh. The board displayed with in the bus on the wind screen which had been planted shows the route Chandigarh to Amritsar.

That the ticket number of the bus of Punjab Roadways Amritsar II by which I traveled from Phagwara to Kharar on 4th April 5, 2007 amounting to Rs. 56 is (Ticket No.584521-amounting to Rs. 50 & 005820 amounting to Rs. 6)+ Rs. 12 from Kharar to Chandigarh)

That I returned by Punjab Roadways Nawanshahr Bus and boarded from Sector 43, Chandigarh. The conductor of said bus issued me the ticket No. 912727 that belongs to Pb Roadways Nawanshahr for Rs. 60 and ticket No. 592957 for Rs. 7 ticket that belongs to Punjab Roadways Ludhiana = Rs. 67 fare from Phagwara to Chandigarah in a same bus.

I submit



INTRODUCTION:

1. that I, Rajneesh Madhok, S/O Shri Sat Parkash Madhok, r/o Nehru Nagar, Street No.2, Railway Road, Phagwara, District Kapurthala, aged 43, is the complainant in the case have undertaken the journey along with my two daughters, namely, Akankasha Madhok and Shivangi Madhok, aged 17 years and 17 years (both twins) respectively, who are patients of asthma, on the Punjab Roadways Bus on route from Amritsar to Chandigarh on the critical day of 15th Feb, 2007.



1.1. that I am also the complainant for and on behalf of fellow consumers of transport services in Punjab who are silent sufferers as permissible under the Consumer Protection, 1086 (Amended).



1.2. that I am submitting herewith the necessary Affidavit executed before the Oath Commissioner in support of my submissions in this complaint.



2. that the respondents are the persons responsible for implementing the policies of the Government of Punjab in the Department of Transport under the Kilometer Scheme according to which the bus operators charge the government authorities for the trips undertaken.



3. that I further submit that I could not note down the names of the conductors and drivers of the bus that I along with my daughters traveled on.



4. that I also could not note down the registration number of the bus in a fit of anger at that time.

5. that because of the general apathy of the people none of the fellow passengers came forward to join me in the protest against the whims and fancy of the conductor and driver for terminating the journey at Nawanshahr, a significant distance that not only put the passengers to financial loss but also physical and mental harassment. And, that in that state of affairs none of the fellow passengers name and addresses could be noted. However, this being the general state of affairs and practice in the State can be easily got verified through the means available with the authorities at least by putting an advertisement in the press inviting public grievances with evidence.



COMPLAINT:

6. that my complaint is that the conductor in collusion with the driver of the bus that left Phagwara at about 11 A.M. on 15th day of February 2007 terminated the journey at Nawanshahr, short of 100 Kilometers, much before the destination, without refunding the money for the distance not covered by the tickets purchased by the passengers like me and my daughters. The distance from Amritsar to my station, namely, Phagwara is about 100 kilometers, whereas our journey was cut short by the said driver & conductor for about 100 kilometers.



7. that my complaint is also that the chances of the bus operator (driver and conductor) having charged the government for the full kilometers of distance from the starting point i.e. Amritsar to Chandigarh for 250 & 250 to and fro means 500 K.M.s run. That they are putting the state exchequer to great financial loss.



8. that my complaint is also that there is a good chance to reckon that the bus in question may not be operating with genuine registration number/licence for the route, further putting the state exchequer to huge financial losses.



RELIEF SOUGHT:

9.1. that the respondent No.1, Secretary Transport, Punjab Government, may kindly be directed to produce before the Hon'ble State Commission full details of the kilometer scheme operating in the State, and the procedure for implementation of the same & General Manager, Punjab Roadways, Nawanshahr full details of the arrival, stay and departure of the bus from Nawanshahr Bus Stand with the detail of arrival and departure from (last station of arrival) and to (the station of destination)

9.2 that the Respondent No.2, Controller of Transport, Punjab Government, may kindly be advised to place before the Honble Commission the routes falling under Kilometer Scheme, names and addresses of the transporters, buses with registration numbers authorized to operate under the scheme, the stations between which these buses under the Kilometer Scheme operate, and the claims of the operators for payment under the K.M. scheme.



9.3. that the Respondent No.3, the Traffic Manager in-charge of the Amritsar Division, may kindly be advised to place before the Honble Commission the details of the checkings done during the month in question with clear indications of operations from and to.



9.4. that the Respondent No.4, Adda In-charge of Amritsar Bus Stand may kindly be advised to place before the Honble Commission the names and addresses of the Bus Operators, registration numbers of the buses and their timings of departure from Amritsar along with the arrival times at the destination stations on that critical date mentioned above.



9.5. that I, the complainant, may kindly be compensated for the financial loss which stands at by way of damages caused to me and my daughters, physically and mentally, as also the cost of litigation that the honble Commission may consider fit.



9.6. that in the event of determining the case in favour of the consumers, the associations of transporters, or, individual operators as the Honble Commission may deem fit, may kindly be advised to make the losses good by depositing the amount deemed fit by the Honble Commission.



10. that this being a case of public interest also I humbly request to kindly take it up on day-to-day basis of hearing.



10.1. that I am submitting herewith 13 copies of this complaint along with that of the Affidavit duly authenticated by the Oath Commissioner for necessary action by the Honble Commission.
