Bring Home Balbir Singh Bains sign now

Balbir Singh Bains (a UK resident for over 25 years) was wrongfully imprisoned in June 1999 by the Indian authorities, who laid charges of terrorism against him. Whilst in police custody and during his imprisonment, he was physically and psychologically tortured.

After nearly three years in jail without a conviction, he was subsequently found innocent of all charges, which were declared improper and unjust by an Indian High Court. Whilst exonerating him, Special Judge M.L Sahni said the following in his final judgement:

A balloon of falsehoodsthe prosecution story stands falsifiedit is well said that a lie does not have its own legs to stand onAccordingly, I acquit [the] accused of the charges framed against [him]

It was even more shocking when shortly afterwards, an internal investigation conducted by the Intelligence Bureau (I.B) proved that the RDX explosives allegedly found upon Balbirs person were in fact taken from one of their own Store of Operations Units. The officers involved have yet to face justice.

Balbir possesses a valid Indian passport which allows him to return home to his family and friends as soon as an entry visa has been granted by the British authorities; who are torturing him through their inaction.

The British authorities must treat the case of Balbir with the understanding and compassion it rightly deserves. His false incarceration, physical and psychological torture and his separation from family surely warrants special attention.

This denial of free return home is I believe in gross violation of the right to family life as outlined in Article 8 of the European Convention on Human Rights.

For reasons perfectly understandable, Balbir feels that whilst he is left in India his life will remain at risk. The well-being of his five young children is also at stake. It would be appropriate to mention that his daughter Dalpreet is mentally and physically handicapped, and requires full time care.

I urge your government to communicate directly with the authorities involved and to make clear to the Campaign Group the actions that are being taken to bring him home. I as his supporter require clear indication as to what the reasons for this delay are, and what actions are being taken at Ministerial and lower levels.
