Petition to Ban Full and Partial Nudity in the Prison Systems of America that is not Artistically Created for Medical or Textual Basis

I am starting this petition to ban pornography in the prison systems for these concerns:



Pornography should not be allowed at all, in any form, unless artistic or medical, because pornography degrades the moralization of the family, of relationships, and society as a whole. The men and women who receive the pornography in the prison system are allowing their general values and morals to be degraded by the visual images of these women and men. They are allowing their families to be torn apart by the infidelity of their minds, and they are creating unneccessary criminals in a society where sex crimes are at an all time high.



It is a choice to view pornographic material, but it is also a temptation when you are without a physical presance of a partner. I do not see that it is a necessity when you have a wife or the possibility to create a good life with someone outside of the pornographic world.



I see it unfit that the prison system will allow nudity of anyother women in magazines but no pictures nude of your wife or girlfriend.



I see it as sexist because these men come out of the prison system and the women they are involved with must meet ridiculous standards because that is what has turned the men on for so long with their habit of viewing pornography.



I see pornography viewing as a mental illness that is easily turned into an addiction which then gets in the way of the goal for incarcerating individuals to begin with: rehabilitation. If your mind is preoccuppied with sexual thinking, how can you focus on the bettering of a life?



I see that prison guards who are women are demoralized by the attitudes and beliefs of the inmates who view the pornography. I see this as sexual harassment and lewd.



I believe in the goodness and faithfullness of the sanctity of marraige. I do not believe that the prison should put obstacles in the way so that these men can come out of prison wanting to have sex so bad because they are tired of looking at pictures and want the real thing so bad that they then commit sex offenses to satisfy their sexual addictions they have acquired from being exposed to this material in the privacy of their own cell.



Pornography should not be allowed in the prison systems of America. We have enough problems.

Court of Appeal Upholds Rule Against Pornography in Prisons

A California Department of Corrections policy prohibiting inmates from possessing materials showing male or female frontal nudity does not violate the First Amendment, the Fourth District Court of Appeal ruled yesterday.



Div. One affirmed San Diego Superior Court Judge Joan M. Lewis order denying a petition for writ of mandate in which an inmate at Richard J. Donovan Correctional Facility challenged the ban, which went into effect in 2002. The petitioner, Stephen Snow, sought relief after his magazine pictures of nude women were confiscated.



Among the exhibits attached to Snows petition, which he filed in pro per, were pictures of women with exposed breasts, an art photograph of a nude woman, and an issue of a pornographic magazine.



Measure Defended



The department defended the rule as a legitimate measure to protect female correctional officers against harassment, to steer clear of having sexually explicit materials become items of barter, and to avoid anatomical comparisons [that] could lead to fights between inmates.



Attached to Snows reply was a Time magazine article containing a photograph of a painting of a nude woman.



The judge concluded that the ban was reasonably related to a legitimate penological interest, reasoning that officials had shown a connection between inmate possession of pornography on the one hand and sexual harassment and intimidation of female employees and fighting among inmates on the other, that the policy was not an exaggerated response, and that inmate freedom of expression was not unreasonably restricted.



Justice Terry ORourke, writing for the Court of Appeal, said the trial judge was correct. Many cases have found that prison safety and security are legitimate penological interests, the justice wrote.



The regulation also meets the constitutional requirements of neutrality and rationality, he said, adding that Snow failed to present sufficient evidence to refute a common-sense connection between sexually explicit images and the sexual harassment of female correctional officers and other security problems.



Alternative Expression



ORourke also rejected the argument that the ban leaves inmates inadequate alternative means of expression. He noted that inmates remain free possess sexually explicit writings or provocative pictures of clothed persons and that the regulation exempts medical texts, art reference books, National Geographic magazine, and books purchased for prison libraries and educational programs.



The justice went on to say that the rule does not violate Californias inmate rights statute.



Under Penal Code Sec. 2601, ORourke explained, the right to purchase, receive, and read any reading matter accepted by the Post Office is subject to two exceptions, one for obscene materials and the other for matter tending to incite to murder, arson, riot, violent racism, or any other form of violence.



To the extent the regulation bans material that is sexually explicit but not obscene, the justice explained, it falls within the second exception, since it is designed to prevent intimidation of employees and fights among inmates.



The case is Snow v. Woodford, D043702.
