ASFA - 15 of 22 to 24 of 30 sign now

This petition is being posted with regard to P.L 105-89, the Adoption and Safe Families Act (ASFA). ASFA was passed in 1997 in response to dissatisfaction with the child welfare systems ability to meet goals of safety, permanency, and well-being for children. I am concerned about one of the key provisions of this law that requires the termination of parental rights be initiated when a child has been placed outside of his or her home for 15 of the most recent 22 months.

Parental substance abuse is of the greatest challenges facing families that have had their children removed. According to the Department of Health and Human Services (2001), 80\% of the children in out-of-home placement are there due to parental substance abuse problems. Achieving and maintaining abstinence from substance abuse is a difficult process and may take a long time. Often a goal for family reunification is temporary or long term abstinence. Additionally, these parents may also need additional treatment supporting services such as learning appropriate parenting skills or harm reduction techniques.

Substance abuse treatment services vary, however, the longer the length of stay in a treatment program, the more likely are positive outcomes by the parent. Substance abuse treatment for 15 months in outpatient settings and 18 months in residential facilities yield the greatest reductions in substance use. With this information in mind, it is obvious that a substance abusing parents may need more time to establish and maintain abstinence then is allotted by the 15 of 22 month provision within ASFA.

We would therefore ask that this provision of ASFA be changed from 15 of 22 months, to 24 of 30 months. This change is absolutely necessary in order that those parents experiencing substance abuse problems are given a fair chance to meet the child welfare system's requirements with regard to child safety and permanency and so that they may ultimately experience family reunification.

    I did not know this policy even existed. To a child, placing them in foster care is no different them making them live with a kidnapper. When ever and SAFELY possible, they should be wih their real parents!
