O Supremo Tribunal Federal irб em breve decidir sobre a demarcaзгo da Terra Indнgena Raposa Serra do Sol, localizada em Roraima. Anular o reconhecimento da posse permanente dos mais de 18.000 indнgenas Ingarikу, Makuxi, Taurepang, Wapixana e Patamona sobre a integralidade daquela Terra Indнgena significa retroceder no reconhecimento dos direitos indнgenas, negar o direito а diversidade cultural e desrespeitar a Constituiзгo Federal. Esta decisгo nos empobreceria e nos diminuiria enquanto sociedade brasileira.

Desde o perнodo colonial, sгo reconhecidos os direitos dos нndios sobre suas terras. A Constituiзгo de 1988 consolidou e afirmou o carбter originбrio desses direitos. A ocupaзгo tradicional da Terra Indнgena Raposa Serra do Sol foi comprovada por extensa documentaзгo histуrica e longos anos de um detalhado processo administrativo de demarcaзгo.

Em 15 de abril de 2005, o Presidente Lula assinou o Decreto que homologa a demarcaзгo, reconhecendo o direito dos нndios e garantindo ainda a aзгo das Forзas Armadas e da Polнcia Federal para a defesa do territуrio e da soberania nacionais. Do ponto de vista jurнdico, nгo hб argumentos que justifiquem a invalidaзгo do procedimento de demarcaзгo.

Os direitos dos 18.000 нndios da Raposa Serra do Sol estгo sendo questionados por aqueles que pretendem fazer com que o Supremo Tribunal Federal, ao anular a demarcaзгo da Terra Indнgena, permita que as garantias constitucionais possam ser substituнdas por interesses polнticos e econфmicos, que neste caso pretendem consolidar seus objetivos predatуrios sobre a Amazфnia brasileira. Se isso ocorrer, estaremos admitindo que em nosso paнs alguns tкm mais direitos do que outros e que o equilнbrio consolidado na Carta Constitucional pode ser quebrado conforme o peso do interesse em questгo. Ao abrir um precedente deste tipo, nгo sгo apenas outras terras indнgenas jб demarcadas e homologadas que poderгo vir a ser igualmente questionadas e fragmentadas, mas os direitos de todo e qualquer cidadгo que eventualmente se colocar no caminho do interesse polнtico-econфmico da vez.

A Constituiзгo completa 20 anos em outubro e a decisгo no caso da Raposa Serra do Sol precisa honrб-la, resgatando a dignidade aos povos indнgenas, fortalecendo nossa democracia pluralista e o Estado Democrбtico de Direito no Brasil. Pedimos que o Supremo Tribunal Federal se posicione em favor da manutenзгo da demarcaзгo da Terra Indнgena Raposa Serra do Sol, garantindo os direitos indнgenas e o cumprimento da Constituiзгo brasileira.

Please, sign this petition in support of the indigenous peoples of the Raposa Serra do Sol Indigenous Land, in the Brazilian state of Roraima, to ensure that the current borders of their land are maintained.

The Brazilian Supreme Court will soon rule on the borders of Raposa Serra do Sol Indigenous Land, in Roraima State. The reversal of the recognition of the entitlement of over 18,000 indigenous peoples (Ingarikу, Makuxi, Taurepang, Wapixana and Patamona) to the whole area of their traditional lands would represent a setback for indigenous rights in Brazil and for the right to cultural diversity, and an affront to the Constitution.

The rights of the indigenous peoples over their land have been recognized since colonial times. The 1988 Brazilian Constitution affirmed the historic nature of these rights. The traditional occupation of Raposa Serra do Sol Indigenous Land was proven by extensive historical documentation and by an administrative process of land demarcation which took many years.

On 15 April 2005, President Lula signed a Decree which ratified the current borders of Serra Raposa do Sol, and in doing so recognized the rights of the indigenous peoples who occupy the area and ensured that the Armed Forces and the Federal Police defend the territory and therefore Brazilian national sovereignty. From a legal point of view, there are no arguments to justify the overturning of the demarcation process.

The rights of 18,000 indigenous people in Raposa Serra do Sol are being questioned by the Roraima State government in the interest of a handful of powerful rice farmers, who would like to undo the demarcation of Raposa Serra do Sol Indigenous Land. Their intention is to replace constitutional guarantees with economic and political interests, that in this case aim to consolidate their predatory action over the Brazilian Amazon. If the Supreme Court lets this happen, it will allow some in Brazil to have greater rights than others, and allow the balance set by the Constitution to be broken according to the influence of private interests. By opening a precedent of this sort, not only other indigenous lands already demarcated and ratified may be equally questioned and fragmented, but also more broadly the rights of any citizen in the way of political and economical interest.
The Constitution will celebrate its 20th anniversary in October and the ruling on Raposa Serra do Sol must honor it, so as to ensure the dignity of indigenous peoples, and to strengthen pluralist democracy and the rule of law in Brazil.

We therefore call on the Supreme Court, to rule in favor of the demarcation of the Raposa Serra do Sol Indigenous Land, securing the rights of indigenous peoples in line with the Brazilian Constitution.
