Petition to Amend Tennessee Annotated Code 40-32-101



This petition was established to amend Tennessee Annotated Code: 40-32-101 by restoring the section in which in certain circumstances, destruction of public records regarding conviction of person who committed offense when they were less than 21 years of age. For 3 years this procedure was on the Tennessee law books, but was removed in March 2005 for being a typographical error. The real error was that when someone actually tried to benefit from this law, other than one specific individual that the original legislation was created for in 2000, they changed the law.

What are the goals of this petition?

*Gather support from the community to lobby the state legislation to amend the Tennessee Annotated Code 40-32-101.

*Make notice to the state legislated body that when the bill was originally passed it only benefited one individual. The passage of the original bill in 2000** was unethical and considered personal interest legislation.

*To restore the section (6) of Tennessee Annotated Code 40-32-101 which states:

6) All public records of a person who has been convicted of an offense that was committed prior to such person's twenty-first birthday shall, upon petition by such person to the court having jurisdiction over the original conviction, be removed and destroyed if such person:
(A) Has not been convicted of an offense except for the offense to which the petition pertains;
(B) Was not convicted of a sexual offense as defined by 40-39-102(3) [repealed]; and
(C) Pays a fee to be established by the court for the destruction of such public records; provided such fee shall not exceed twenty-five dollars ($25.00).

The passage of this legislation is paramount in the passage of future legislation that will benefit all ex-felons who have been incarcerated and are limited in their ability to find employment due to having a criminal record. The failure of this amendment will have profound affect on future legislation to remove limitation of a conviction.
