I would like to have California Penal Code Section 1203.4 Amended for the following reasons; The Expungement of criminal records can only be offered to persons convicted and sentenced to a "County Jail Facility". Any persons that serve 1 day in a State Prison Facility, may not have their day in court to have their criminal record Expunged. Most former inmates, return to committing crimes due to not being able to find work that can reasonably support themselves or their families. I am not seeking this relief for any violent offenders, sexual deviance crimes or any life time criminals. Only persons that have demonstrated that their lives have dramatically changed and they are not able obtain employment, housing or a business license due to their criminal history. In short, the same crimes that can be expunged for persons sentenced and convicted of any Wobblers, should also be Expugnable to persons that took a plea and went to prison for the exact same crime.

In California, Wobbler refers to a criminal offense that can be classified as either a misdemeanor or a felony. It Wobbles between these two categories of offenses. It signifies a lesser felony offense that specifies fines or jail time as alternative punishments to state prison. California defines over a hundred offenses as Wobblers. For example, driving under the influence, battery with serious bodily injury, petty theft, simple grand theft, and receiving stolen property are all common Wobblers. Conviction of a Wobbler is considered as conviction of a crime.
This right is granted thru the 14th Amendment to the Constitution.

All persons born or naturalized in the United States, and subject to the jurisdiction thereof, are citizens of the United States and of the state wherein they reside. No state shall make or enforce any law which shall abridge the privileges or immunities of citizens of the United States; nor shall any state deprive any person of life, liberty, or property, without due process of law; nor deny to any person within its jurisdiction the equal protection of the laws.
