1998 Injustice - Michael's Fight For Freedom sign now

In 1998 Michael Pasour witnessed a stranger (a man being treated for paranoid schizophrenia and known for his interest in child pornography) trying to abduct his 5 year old son. Michael intervened before the abduction attempt was successful. The police were immediately notified and Michael gave them a description of the suspect, a description of the vehicle he was driving, complete with license plate number. The police searched the immediate area for approximately 30 minutes, returning only to Michael that their search was unsuccessful. The police stated to Michael that if he were to see the suspect again, to notify the police of his whereabouts. Michael agreed to do so. Less than an hour later, a friend of Michael's (that also witnessed the abduction attempt) saw the suspect's car parked at an apartment complex not even a block from Michael's home. Michael again notified the police of the suspects location and stated that he & his friend would meet them there. Michael wanted to meet the police there since he & his friend could positively identify the suspect. Upon arrival, Michael did not see the police. He ran to an elderly lady sitting on her porch and asked that she call 9.1.1. to give the exact address of their location. This was the third 9.1.1. call placed requesting assistance of the police. Michael & his friend went to the apartment door which the suspect's vehicle was parked in front of. Michael & his friend knocked on the door and requested that the suspect come outside to talk with the police. No one responded from inside of the apartment. Knowing that the suspect was inside, Michael & his friend began pounding on the door trying to get a response. They were afraid that the suspect would elude the police again. While pounding on the door, trying to get the suspect to come outside, the door inadvertantly pushed open. No one emerged from the apartment's door so Michael & his friend took a few steps inside because they thought the suspect had in fact eluded the police. The suspect was not in the apartment so they left the apartment and started walking towards the suspect's vehicle where they were going to wait for the police. As they were walking down through the apartment complex courtyard, the suspect approached them gaining their attention by yelling & cursing at them. As Michael turned, he saw the suspect approaching with his hand behind his back. Michael asked that he relinguish the weapon that he had hidden and informed the suspect that neither he nor his friend had a weapon with them. Michael also told the suspect that the ONLY reason they were there was to make sure that he (the suspect) talked with the police. The suspect informed Michael that he would not talk with anybody and pulled the gun from behind his back, pointing it directly at Michael. Instinctively, Michael's friend grabbed the man's gun hand as Michael struck the suspect with his fist. All three men fell to the ground. Michael's friend continued to struggle for the gun and Michael struck the suspect with his fist approx. 2 to 3 more times. The gun was released from the suspect's hand and Michael's friend kicked the gun up towards the apartment complex where it would be out of everyone's reach. As Michael made his way to his feet, he noticed that the suspect was having difficulty breathing. Michael ran back to the elderly neighbor and asked her to, again, phone 9.1.1. "This time, tell them we need an ambulance and please ask the police to hurry." Finally, the police arrived and immediately placed both Michael & his friend under arrest. Michael did not find out until much later that the impact of the fall and/or the combined weight of both he & his friend had broken the man's neck. The suspect died and both young men were charged with first degree murder. Michael's case went to trial in 2001. The Prosecuting D.A. blatantly gave false information to the jury which prompted an objection by the defense attorney. The judge sent the jury out of the courtroom while evidence of the false information was being heard. When the jury entered the courtroom, they were only told to strike that statement made by the D.A. By that time, the false information had already been planted. The judge ruled against the defense throughout the majority of the trial. He would not allow crucial evidence to be entered even though this evidence would corroborate Michael's statement of events. Even though the D.A. and judge worked together to seal Michael's fate, the jury still sent out three separate requests asking for the instructions of self-defense and manslaughter. Each time this request was made, the judge gave the complete set of instructions including first & second degree murder. On the final request, the jury said, " It has become imperative that we ONLY receive the instructions of self-defense & manslaughter. WE ARE NOT INTERESTED IN ANY OF THE OTHER INSTRUCTIONS." This last request came in on Friday night. The judge sent the jury home only to have them return on Monday morning where he introduced a brand new set of handwritten instructions. The new instructions that were given were a rewritten form of first degree murder with manslaughter pertaining to that charge and second degree murder with manslaughter pertaining to that charge. This made second murder the least charge available for the jury to deliberate on. It was obvious that they (the jury) did not want to convict of any murderous charge, but the judge would not allow them to do otherwise. The judge simply would not apply the law within Michael's RIGHTS. The judge wasted no time in sentencing Michael to the most stringent sentence possible, 19 TO 24 years. Michael has already been incarcerated for almost 5 years of that sentence. Time is crucial in this matter as it is clear that Michael does not belong in prison. He is a good man that the Judicial System overlooked to claim victory for a man with dishonorable intentions toward children. This is not Justice.
