SEEKING DIRECTIONS TO MEA TO HELP OCTOGENARIAN LADY IN CLAIMING INHERITANCE FROM JAPAN , PENDING SINCE 1949 . IN REF : PROPERTIES OF SH. NANAK SINGH ANAND IN JAPAN. sign now

                                                            After having exhausted all my pleading options with the Government of India ,  I write this Petition with hope and seek  help in fulfilling the utmost and certainly My last wish  of bringing the legacy of  My late father home to his heirs from Japan to India .  My Father went to Japan in 1935 from a small village of erstwhile undivided Punjab. He was stuck there during the second world war but was established there in business and created several movable  and immovable   properties . After the war he re-established contact with His family and when His family returned as refugees to New Delhi after the partition in 1947, He wrote to the Govt. of India to help Him arrange for moving His family to  Japan . While His Family ( consisting of My Mother , My Brother , Myself and My Husband  ) was in the process of applying for passports etc. , shocking news of My father’s sudden , tragic and un-natural death was received in January 1949.

 

                                                          My Brother, Sh. Gurbax Singh Anand (who was just Twenty then) ,  with the help of Govt. of India , tried to go to Japan to manage Our Father's properties , but gave up His efforts in 1957 , perhaps because of paucity of funds . His plight can be imagined as death of Our father in Japan meant abrupt stoppage to remittances from Japan , and as a refugee He had to start from scratch to maintain Himself and His Mother and start a family for Himself .  After My Brother’s  death in 1985 and My Mother's death in 2002 , the file containing the original and entire correspondence between My Brother and the Ministry of External Affairs , Govt. of India came into My hands and since then I have taken upon Myself to get all the heirs Our due .

 

                                                         I was able to revive / reopen our case in 2009 and was able to establish contact with the Indian Embassy in Tokyo and through them with the Office of the Consulate General of India in Kobe / Osaka as the properties are mainly situated in Kobe and the nearby areas . Although I have exchanged several communications with  the Office of the Consul General of India at Osaka-Kobe , I feel as helpless as My Brother must have felt in 1957 , as the matter still rests where it was in 2009. Despite enclosing  several papers from the above mentioned file , including a POSITIVE TITLE SEARCH  undertaken by Consulate in 1956 , My claims have been dubbed as SUPPOSED AND EVEN PURPORTED by the Consulate .There are at-least 10 properties belonging to My  Father  , as can be derived from the above mentioned correspondence and addresses of some of them are mentioned therein .  At-least one of the properties was rented out to the Indian Chamber of Commerce Japan ( ICCJ ) in Kobe and the Indian Mission had directed the Hon. President of the chamber to hold the rents etc.for the heirs . It is ironic that even though the property had been entrusted with fellow Indians , the chamber has refuted all my claims on the frivolous excuses of lack of records and accounts .  It is now my firm belief that  our case needs to be highlighted and to be promoted to highest Diplomatic and Political level .

 

           In the last more than Eight years , apart from writing to Japan , I have been trying to contact several Bureaucrats and Ministers of the Indian Government  in New Delhi . I have written mails and submitted my submissions at the MEA Dak Counter addressed to Honourable JS (East Asia ) , Honourable Secretary ( east ) , Honourable Foreign Secretary , Honourable Minister of State in the MEA , Honourable  Foreign Minister Shrimati Sushma Swaraj. I have also made written submissions to the  Honorable Prime Minister Shri Narendra Modi Ji . I have also made a humble on – line submission to the Honorable President of India which was forwarded to the Consular Section of the MEA.

 

 

 

 

 

                                                                            It is regrettable that the MEA bureaucracy , including the Embassy at Tokyo , The CGI at Osaka-Kobe and whole of MEA at New Delhi has turned a deaf ear to My pleadings and not a single positive step has been initiated by any branch . I am pained to write that My E-mails , detailed submissions at the Central MEA Registry and even tweets addressed to Smt. Sushma Swaraj , EAM , have not been put up before Her Excellency

                                                                             A request under RTI has informed Me that the EAMO does not have any entry of My online or otherwise attempts . The MEA elements present in the PMO and the Rashtrapati Bhawan Secretariat invariably redirect My communications to the MEA  . I have practically exhausted all recourses to contact the Honourable President , The Honourable Prime Minister and the Honourable EAM .

 

                                                                    The case being 68 years old I do need Diplomatic as well as Political intervention of the highest level . And bilateral relations between the two Countries were never better .

 

                                                                            Even by conservative estimates , the present day value of these properties must be in thousands of  crores  of Rupees and it is likely to generate hundreds of crores of Taxes / Duties etc for the Government of India.

 

                                                                             I hereby request that instructions / directions be issued not only to  Smt. Sushma Swaraj , Honourable EAM  but also to the Honourable PM and  to the Honourable President of India .

 

                                                                            even after the discouraging , cold shouldered and unexpected response of the Honourable  CGI , Our family has not lost faith in the system and request your kind Honour to please take Suo Moto cognizance of the  matter  and carry it to a positive end . We still believe that we have been following the right procedure and approach and we HAVE NOT WASTED EIGHT LONG PRECIOUS  YEARS . I request that our sufferings are not extended by the oversight , casual approach , any commission , omission  or undermining one’s own authority by any Bureaucrat or Minister of the Government . It is ironic , that while the whole Government Machinery was pushed into digging for hidden treasures on the basis of someone’s dream , I have  been pleading haplessly for the last eight years to get to My Father’s factual treasure (legacy) .
