Phil Woolas & Joe Fitzpatrick Punished for Inciting Racial and Religious Hatred sign now

To Harriet Harman, GMPA, & EHRC,

We, the undersigned urge that you acknowledge and take action against Mr Phil Woolas and Mr Joe Fitzpatrick.

I am sure you are aware of the verdict of the election court, involving the former Labour Shadow Immigration Minister, Mr Phil Woolas, which has lead to the void of his position as a Member of Parliament.

In his campaign, which Mr Fitzpatrick masterminded and actively promoted material was used which incited racial and religious hatred in the Oldham and Saddleworth Community; material that was recently proven to be lies in the specially convened court.

Furthermore, the Judiciary Report for the case explains that the same trial case found that Mr Fitzpatrick, with the direct knowledge and permission of Mr Woolas, intended to incite racial and religious hatred by the use of the following lies:

Point 147: Fitzpatrick email: “I think it’s fabulous… I do think we need to do an article on the game plan and the numbers to explain to the white community how the Asians will take him out… If we don’t get the white folk angry he’s gone.”

The scope of this verdict was in the Representation of the People Act 1983, which does not have the scope for prosecution upon inciting hatred upon racial and religious grounds. However, there is a serious case of racial and religious hatred with regards to Mr Woolas’ and Mr Fitzpatrick’s conduct.

Under the Public Order Act 1986, Part 3, Section 18:

“Use of words or behaviour or display of written material.

A person who uses threatening, abusive or insulting words or behaviour, or displays any written material which is threatening, abusive or insulting, is guilty of an offence if—

(a) he intends thereby to stir up racial hatred, or

(b) having regard to all the circumstances racial hatred is likely to be stirred up thereby”

In Anti-terrorism, Crime and Security Act 2001 Part 5, Section 38, the same definitions had been extended to “racial and religious hatred” whereby religious hatred is defined as:
“....hatred against a group of persons defined by reference to religious belief or lack of religious belief.”

Mr Woolas and Mr Fitzpatrick have certainly displayed this behaviour in the material that they published to win the election. They have displayed behaviour in which point (b) [as stated above] comes into play in incitement of both racial and religious hatred between members of the community from different cultural and religious background.
In light of this, we demand, that Mr Phil Woolas and Mr Joe Fitzpatrick are:

1. Removed from the Labour Party (if not already done so)
2. Removed from and banned from a positions of public office and social responsibility
3. Tried in a court of law for Incitement of Racial and Religious Hatred
